Understandable that Economic Stimumus Package is not a federal recuring benefit. However, ITIN holders (H4s) are eligible to claim child tax credit, why not this stiumuls benefit?. They should be given this benefit if they meet residency requirement. One should contact IRS to include ITIN holders to clain this benefit.
The IRS cannot make exceptions, since it is written in the law. However, the Social Security Act does not say that the benefit has to be recurring. I did get a reply today from the SSA. They claim the stimulus payment is a tax rebate, not a benefit. However, it cannot be a tax rebate, since the law was written to allow people with no income to apply for the check. There are even instructions on the IRS website that explain how people with no income can apply for the check. I am in the process of getting the opinion of an attorney. I will update you soon.
One last thing. I recommend that any discussions you have with the SSA be in writing. The SSA manager wanted to discuss this with me over the phone, but I insisted on written correspondence, because that is the only proof you have if this ever goes to litigation. I really take exception to that comment. I have 2 Masters degrees (one from the US)...unfortunately they are not in Engineering/Science. What people don't seem to realize is that it is extemely difficult to get an H1-B if you are from a Humanities/Liberal Arts background. I'm a teacher and there are jobs in my field...the only problem is that school districts/community colleges/universities are unwilling to sponsor H1-Bs!

Certainly Canada is much much better option. Wish people had talked about it 10 years ago. So for those who just came to America or those who are deciding where to go to work or to school, Canada should be the first choice. You will actually have more flexibility being a Canadian than American.

Apart from the bad language used by some people .... I dont believe that there is any infighting .... disagreements with point of view is not infighting ... It just a primer for the points and discussions that will definitely come up when lawmakers will argue their points of view. Jaime, your thought of having one more rally in Silicon Valley is a good one but again you are going to have the same crowd..!!
People in neighbouring states of DC did not make it , you tthink they will make it all the way to west coast! very doubtful!!
We should aim at bringing in more people to this family as possible..
Looks like a simultaneous rally on a weekend will be very effective!
And this time for the rally we will carry one one slogan banners
'SHORTEN THE WAIT FOR LEGAL IMMIGRANTS' or something similar!

Agree with you 100%. I have been waiting patiently all along hoping something good would happen for EB3. I am talking to my employer if they can port my case to EB2. I have a master's degree and about 13 years of experience (8 years in the current job). My only concern is if the new EB2 labor or I140 doesn't get approved for some reason, can I fall back to my current EB3 application. I don't want to jeopardize my current application just by deciding to port to EB2. Any suggestions?
If I were you, I would make it clear to the employer that you qualify for tier 1 in UK and educate them on benefits of tier 1 vs waiting for green card then go from there. It worked for me.

Mirage..you are absolutely right...i paid 765$ as per old fees for I485,EAD,AP. the new fees for I485 is 1010$ and EAD,AP can be concurrently filed with no fees.also, since I485 is filed with new fees there will be no fees for renewals.so, basically 1010$ one time fee with the new fees structure and 765$+645$(EAD+AP) with every renewal every year.(if it becomes 2 years then for every 2 years).i wish i had paid thru new fees.this is completely unfair and big BS......

One more in same boat here .. EB3 India approval email received.. Dependent not approved , RFE for photos on EAD application .. EAD expires in one month ... lot of frustrations and trouble on my way I guess!!!!
Though I haven't been able to get proper info from INS, I believe my approval is legit. I have had an EB2 I-140 approved in 2006 from a different employer. The GC approval notice shows the PD of 2002 (EB3 PD) and category of E26 (which I have learned EB2).
It looks my case is considered as 2002 EB2 , if I ever knew this I could have tried to get an approval earlier.
we see more and more cases where some smart USCIS system auto porting the applications to EB2 /earlier PD if one have different I140 approved. Another example is for an IV member texanmom .

what is the phone number to call uscis regarding the july 2 query.
Called uscis and asked what happens to the app already received by them?
The rep put me on a hold..(guess went and asked somebody) and answered that all the app received will be put on hold(not returned) and said they will not process ead/ap too.Di anybody else tried calling and ask the same?did they tell the same thing?Just want to know if i interpreted it right?
