PD, I don't agree with the phrasing of the new Labor Cert clause. That is not how I read Frist's bill. Did you make up the new labor cert clause yourself?

I think they will. Here is how the new labor certification clause will read:

Also, this clause says that the degree has to be from a US university. I think Attorney Mathew Oh is wrong in saying that graduate degree holders in STEM from foreign universities can apply too.

I have a situation.I got a H1B transfer and i was working let it be z compsny.after few months i try to transfer to another company let it be X.before I start working over there in X company ,I gave my H1 for transfer.meanwhile i left the Z company and joined in new company let it be y.So in y company applied for H1B transfer meanwhile i got H1B approved from x company.But i havent work in X company even a single day.
I was working with Y company and I got regular paystubs everything with those things they applied for H1b transfer in my Y company.after few days we got a query that some evidence required .we provide the evidence also.now the case statues is "Evidence Received Case Processing Resumed".
and its taking time .Is there any problem .Will the case will be approved?

Just with few members going against you within couple of hours, you are backing from your point. Then imagine how tough it will be to work for our goals working against our forces on daily basis in this country.
Just less than a day and few members are enough to push you back. Having similar and stronger opposition IV is still live. This one is enough to prove the leader ship.

EB I is really beaten up and no respite at the corner. And yes, it looks awkward when even late EB2 filers going way ahead ... Of course, no offense...But just wish EB 3 too has the same treatment....

The updates are provided periodically on forums from IV core. We are currently working on the House side for pushing SKIL forward. There are a few things missing in SKIL bill that we would like to get introduced. Mainly its the 3-year extensions of EAD and AP and 3- year ext of H1 for labor applicants that is missing.
We are also trying to assess of SKIL in house is gonig to go forward, and in the event it doesnt, what other bills can be vehicles for putting our provisions like the S 1932 style.
We try not to restrict free voice and opinion from members on forums however, if it gets downright nasty we will edit posts and censor. But in principle we try to avoid it as much as possible.
If you have questions, and if you think that IV core is not up to the job and needs help or needs to pace up, or if you think you have questions for IV core, please pick up the phone and call the 281 number listed on the website's "Contact Us" and call us. WASHINGTON -- Greeley Mayor Tom Selders wants to know when Congress is going to address immigration reform.
It's a simple question, but the answer is as elusive as the proverbial dog's tail -- a dizzying chase of vague answers and insufficient information.
"It seems to me like people are talking about immigration issues all over the country," Selders said. "I think that it is really sad that the government can't put a priority on it."
The latest source of Selders' frustration was a meeting of business and community leaders in late January with Sen. Wayne Allard, R-Colo.
"We were disappointed with Allard's response," Selders said.
Sean Conway, Allard's chief of staff, said Allard never promised to bring up immigration at this particular delegation meeting.
"What he talked about was that he would be glad, as the process began to move forward and as concerns were brought forth, to pass those concerns on" to the delegation, Conway said.
Conway said Allard would very much like to see the issue brought up in the Senate, but that as far as he knew, it was not at the top of the Democratic agenda. "This is an issue (Allard) very much wants to be involved with and has been involved with," Conway said.
But Sen. Ken Salazar, D-Colo., said immigration was a major issue that would be addressed this year, maybe as early as March.
"I think it is just a matter of time as to when we are able to get to it and I hope it is sooner than later," he said. Salazar is working with the Senate leadership on the immigration legislation, which will be sponsored by Sen. Ted Kennedy, D-Mass., and Majority Leader Sen. Harry Reid, D-Nev.
But for Selders, soon is not quick enough.
"We have frustration here. We see a lot issues and turmoil and some very nasty comments," he said. "(City officials) have all taken oaths of allegiance we will enforce the laws of this land and the frustration is that we lack the resources to do that. The laws are unclear and we lack jurisdiction."
Immigration's National Outlook: Cloudy
Outside of the Colorado delegation, consensus and clarity on when the immigration will receive top billing by Congress is not much better.
Congress, under Democratic control, is actually in tune with President Bush on immigration for the first time in years. Despite this, few observers believe that a comprehensive immigration bill will pass this year.
One of the few is Bob Dane, press secretary for the Federation for American Immigration Reform, who said President Bush and the Democrats were "locked and loaded" to pass immigration reform that included a guest worker program, or "amnesty."
"I don't see how immigration can be an issue leading up to the 2008 election," he said. "It's such a volatile issue. We are guessing that they want to get it done before the election."
But John Keeley, director of communications for the Center for Immigration Studies, a think-tank that researches immigration, was not certain. He said many of the freshman democrats, known as "Blue Dogs," who gave the Democrats the majority, were elected on immigration platforms that were against a guest worker program, favored by Bush and the Democratic leadership of Congress.
"On the horizon of the 2008 general election we tend to think that it is not likely we will see significant legislation," as opposed to last year, he said.
Keeley said instead of landmark legislation, lawmakers will try to pass bills or amendments that only address small pieces of the issue.
That process has already begun. A bill was introduced in the Senate that would set up a guest worker program just for agriculture workers. In addition, a provision has been attached to minimum wage legislation that would withhold federal contracts from any company found hiring illegal immigrants.
But the Democratic leadership is hoping to have a comprehensive immigration bill on President Bush's desk by the end of the year.
Laura Capps, a spokeswoman for Sen. Ted Kennedy, D-Mass., said the senator, who is the Senate subcommittee chair on immigration, border security and citizenship, was hoping to have the Senate bill introduced in late February or early March. Capps did not know of an exact date yet.
The real fight is expected in the House, not the Senate, which passed bipartisan legislation last session. The Republican House leadership was uninterested in the guest worker program, however, and only discussed the border enforcement aspect --the so-called 700-mile border fence.
Rep. Zoe Lofgren, D-Calif., the chairwoman of the House subcommittee on immigration, border security and claims, plans to begin the committee process "promptly." But her spokeswoman, Kyra Jennings, said no date has been set to begin consideration of an actual bill.

Immigration is the most contentious issue that I have worked on during my tenure in Congress. It is imperative that we first secure our borders and enforce our existing immigration laws before we attempt to implement comprehensive immigration reform. According to the Department of Homeland Security (DHS), just over 600 miles of border fence has been constructed along the Southwest border to date. In more remote areas, DHS is using tower-based integrated cameras and sensors, ground-based radar, mobile surveillance systems, and an unmanned aerial system. These initiatives are in addition to border patrol agents who are actively patrolling the areas.
I have consistently supported providing the Department of Homeland Security with the necessary tools they need to protect our country from those who seek to cross our borders illegally. For instance, in July 2009, I supported an amendment requiring the completion of 700 miles of double-layer physical fencing along the U.S.-Mexico border by December 31, 2010. This amendment follows through on the three-year-old promise made by Congress and the Department of Homeland Security to secure the border under previously passed legislation.
We must also address the illegal immigrants that are currently in our country. I will not support any proposal that provides amnesty or a path to citizenship for those that are currently here illegally. Additionally, I will continue to support programs like E-verify that provide employers with tools to verify whether or not current and prospective employees are legally allowed to work in the U.S. Since its inception in 1996, the E-Verify program has provided employers with a process to verify the work eligibility of new hires. E-Verify is free and more than 87,000 employers are enrolled in the program. According to U.S. Citizenship and Immigration Services, more than 1,000 employers voluntarily sign up to use E-Verify each week.
On July 8, 2009, the Senate passed H.R. 2892, the "Department of Homeland Security Appropriations Act, 2010." Included in this bill was an amendment, offered by Senator Sessions, which removed the sunset date on the E-Verify program, and requires federal contractors to participate in the E-Verify program. With my support, the Senate passed this amendment by voice vote. This program began September 8, 2009, and requires federal contractors to use the E-Verify system to check the immigration and citizenship status of new hire and those assigned to new federal contracts.
Immigration reform is one of the most important domestic issues facing our nation today. The President and Congress must work together to secure the border first. Once this is done, we can work to resolve the collateral issues. I believe we can get there, but we are not there yet.

There are always exception in the constitution. For example for US president and Vice President only US Born citizens are eligible. In a way you can argue that is also discriminatory.
If anyone thinks country quota is violating law he can easily challenge that. Green card process is not by merrit. Labor and I140 process is not selecting best candidate. That is just checking whether the position exist and the person is eligibe for that. All of the eligible candidates will get. If no country quota then FIFO process will be applied. It is just cutting the line and not selecting best candidates. So company or country will not have any impact on who gets green card first

I recently switched employers using AC21 and am using my EAD to work for the new employer.
I used to be on the H-1B visa when I was working for the old employer, they had applied for renewal just before I left, and it got approved right around that time. Now that I don't work for them anymore, they are having the H-1B revoked. Of course, they were kind/professional enough to intimate me of this before doing so.
I am wondering if this could have any adverse effect on my 485, or if it could provoke an RFE? Any thoughts/stories would be appreciated.

I used to be on the H-1B visa when I was working for the old employer, they had applied for renewal just before I left, and it got approved right around that time. Now that I don't work for them anymore, they are having the H-1B revoked. Of course, they were kind/professional enough to intimate me of this before doing so.

Attorney applied for my H-1b transfer in the first week of June'08 and I have still not heard back. How long does it typically take to receive Receipt Notice?

I have been thinking about whether to attend the rally or not from past few weeks.
Attending the rally would require me to take a day off. Finally today without thinking twice I just went to my manager asked if I can take day off on 9/18 instead compensate the work in the following saturday. It was approved and I am attending the rally on 9/18!
I am feeling so good now.
No one who, like me,
conjures up the

The Birth Certificate Affadevit posted as a sample soes not have space for 2 people to sign. Should there be nother affidavit submitted by another family member or should the second person just sign below the first persons affadevit?
