This is confusing. In that case how do they make ROW current or PDs way ahead of India? In other words, how do they know without touching a file that PD of a ROW file is current and is eligible to get GC!
Think about the flip side. If this is true, then once they preadjuridict all cases, thousands of ROW cases will immediately become eligible to get GC and India / China will not move for year(s)!

They have already provided some kind of information to the Ombudsman's office so they must already have that information. It makes no sense otherwise how they would determine how many number of visa's they have available for each country or determine what are the PD's for each country.

I finally got the letters and the root cause of my I485 denial. My previous employer informed that they used my approved I140 for another employee. As many of you might know this I140 substitution practice was a loophole until June 2007. These days companies can not do this any more.
So probably when my I485 came up for adjudication, there was no I140 since it had been used and hence they denied it. Now, I changed jobs per AC21 rules--yeah the famous rule that USCIS ignores. I am waiting on my current attorneys to file an MTR as soon as possible.
Question to forum members:
1. Are there folks in EXACTLY similar situation?
2. If yes, after filing MTR and it getting accepted, what are next steps since one definitely needs a approved I140?
3. Further to #2 above, does one need to file another I140 and port the previous date? I am sure this would take longer time than the current H1b that I hold until June 2009.
4. Can any one share lawyer name and contact info who might have favorably helped a forum member so that I can contact the person and get a second opinion to discuss legal strategies that might be available.

When I said that there should be one Item in IV agenda to Ban Porting, everyone got mad.
I still say that they should be allowed to port but should go back in line. they are disturbing the balance. I am not against them, if they were EB2 candidates why they didnt file on EB2 category at first, if now they think they are qualified then they should start new process.
BTW. they will create a big retrogression for EB2 then EB2 people have to port to EB3

What is fair is that we treat everyone here (and everywhere else for that matter) with respect without regard to the country of birth or the EB category. Some are more educated than others, some are more skilled than others, and some are more lucky than others when it comes to green card but what is common to everyone of us is that we are in this mess together. To be honest I don't think we are here to figure out what's best for United States, we are here to get our green card, live the American dream, and make the best out of it.
Therefore, let's not make this GC journey anymore difficult than it already is by fighting amongst ourselves about who is more skilled and who is more deserving. Besides, constant bickering among the IV members will only further divide and alienate more members and won't help us in any way so I suggest that we avoid doing things that has the potential of dividing or alienating members.
Apart from the bad language used by some people .... I dont believe that there is any infighting .... disagreements with point of view is not infighting ... It just a primer for the points and discussions that will definitely come up when lawmakers will argue their points of view. And from that perspective it is enriching this portal forum and not denigrating it.
I welcome the discussion.

Excellent response. I have been a silent admirer of IV for some time. IV has represented the aspirations of all the EB applicants. people should understand that the US allotment of visas to foreign Nationals is only based on what is fair for the country (US). It does not matter to them to what country the applicant belongs but what matters is the qualifications and their benefit to the advancement of the US. I am appauled to see some of the members racheting up this irrational discussion about the spillovers when DOS clearly stated recently what the intent of the law was. the sooner they get over this issue, the better for them and for every one on the forum as the existing rules will NOT change regarding the spillover. we have to concentrate our efforts on how we can improve conditions for every body affected by this retroression. efforts aimed at one category and that too one country will almost certainy fail. I am also shocked to see a few EB3 I expressing anger over dates moving for EB2. personally if I see a person from my country getting his visa approved, then I would feel very happy for him even if I am waiting for some time. I know it will be difficult, but atleast spare some joy for your country men and women who are getting some well deserved relief after such a long wait. one of my old friends told me once "if you have a friend from India, don't rely on him to help you, because you will not get much help moreover some people will only try to pull you down, but if you take people from other countries, it is exactly the opposite as they try to help each other in every possible way". I agree that it is very distressing for every one that the dates are retrogressed, but now that EB2 has moved, all of a sudden some people woke up from a deep sleep and started making these arguments that have no legal basis. None of these people expressed their anger when EB3 ROW was being preferred over more qualified EB2 I and C and making EB2 unavailable. I know a lot of people from EB2 protested at this wrong interpretation of the law, but I don't remember anyone ever criticizing IV for not taking up their cause even though we knew all along that spillover from EB1 to EB2 retrogressed countries was the right interpretation of the law. now some people are asking IV to take up an issue that is straight forward illegal as was clearly explained by DOS in a recent bulletin. instead of wasting time and efforts on such futile suggestions, people should concentrate on making some constructive effort along with IV helping every one involved in retrogression.

What I meant to say, you�ll succeed if you have the capability (with your professional knowledge, experience and skills) in your professional filed but definitely not with USCIS.
I can say, USCIS is a great leveler in this aspect. Everybody from PhD to Programmer is same in front of USCIS. All have to wait 10+ yrs with mental tension and anxiety, no matter what your caliber is and how successful you are in your profession.
Don�t get me wrong here. I also had to suffer for visa stamping, renewals, I-94 issues, PA etc in US Visa processing (nothing sever though). At the 5th yr of H1-B, I just decided.. to hell with that.....
I don't know about you guys, but, I would be heart patient with that kind of anxiety in another 5 yrs of GC process �. Really need a lion's heart to pursue US GC now days

Please don't start shouting at me for being "anti-BEC-victims", because I'm not. But just consider this. Even if you are able to turn mountains around and get a suit filed against DOL before Sept 2007 they will be be able to get it thrown out or at least get a stay simply by stating they already have a public commitment to clearing all the cases by Sept 2007 so it will be non issue in just couple of months. You will not have strong case till Sept 2007 is actually passed and they have not delivered on the commitment. Sept 2007 is just two months away. Use these months to do your ground work like finding and mobilizing BEC victims etc. and go for the actual action only after Sept 2007 dead line has passed. This way if they really deliver on their promise you would save yourself lot of money and trouble.
Just my 2 cents. Your grievances are 100% genuine and I do feel for you. Hopefully they will clear this mess soon.

You will be fine as per the rules. Just make sure you hire a very capable and reputed attorney, just in case the one you have isnt the best. I faced something like this, with 140, and went to one of the big firms we quote many times here and the case was approved with an MTR in just 20 days.. DOnt loose heart. But make sure you do the documentation whatever is needed and make no compromises there. Provide more thats relevant.

There is no way for a bank to know when you leave. You might leave on vacation or for a break. As per US law you can come to US after a year break outside US. in the MN chapter, it's hard to even get replies to e mails, forget meetings etc. of late though i'm glad to say the MN chapter has really beugun to pick up again.
ask the tri state guys how much effort they put locally- meetings- fliers- phone calls, all by a handful of volunteers. so all this is good in theory and yes it takes time. but the apathy (even hostility) that was encountered was frightening. ask chanduv23 someday what the tri state guys went through...
