Worldwide Limits
(a) FS Preference Limitation:
The overall ceiling for relatives is 480,000, from which the previous year's total of immediate relatives and other family classes which are exempt from the numerical ceiling are deducted to determine the level of family-based preference immigration. Although the difference could be greater or less than 226,000, that figure is established as a minimum for the FS preference immigrant limitation.
Specifically, if such family-related numerically-exempt immigrants and parolees are fewer than 254,000, the family-sponsored preferences will be entitled to more than 226,000 in the following fiscal year. Oh Man..that's a very good one..you made my day..No offense to this thread..i do have home loan with ICICI for the last one year..like others mentioned above, it is easy to get approved while being here..i haven't been to any embassy..everything was done through mails and a local bank..

09/28/2007: Depressing News for the Year-End Backend 485 Delays and Potential Waste of Visa Numbers for FY 2007
Unconfirmed sources indicate that two days before the end of FY 2007, there may be a substantial number of 485 applications for which visa numbers are available but have yet to be adjudicated, indicating that some visa numbers could be wasted this year. We know that the Service Centers have been working day and night and did not have enough resources to deal with the crisis which was brought about by the recent Visa Bulletin fiasco. We just hope for the better new fiscal year that will start from October 1, 2007.
wow. just wow. I dont know what to say. These guys NEVER learn.
huge retrogression, massive backlogs, lives on hold for years, all for this precious resource called a visa number, and they waste them again this year!
Even after ombudsman took them to task in his report.
Even after all the publicity of this issue.
Lawmakers dont allow recapture and USCIS keeps wasting them year after year.
This is sickening...

In such cases you need not worry - as the law only kicks in sometime in oct 08 - again the language is not certain until the time the president signs it - More changes are possible in the house if the senate passes it - The conference committee may again change the text

Why is there so much discussion surrounding this stimulus package, I thought all of were highly skilled, high educated clique who made the big $$.
I have seen numerous occasions where people boast of large pay packets, bill rates, and now this is a measly $1,200, an amount that could be made with working 2 days is generating such a huge discussion. This does not add up???
Not everybody on this forum earns 144,000 a year. What world are you living in my friend? Do you not get out that often?

It appears that this is intended to make it official July 2007 Visa Bulletin rather than previous release which was "update" in anticipation of the ALF class action lawsuit. One of the claims which have been addressed by various sources, INCLUDING THIS WEBSITE, was whether "update" can be considered a revised Visa Bulletin for the purpose of the regulations of DOS and USCIS. If it is not, the USCIS would have no authority to reject the I-485 applications in July.
There is still confusion as to which one is considered July Visa Bulletin which is provided in the DOS and USCIS regulations as they have released three versions: (1) Visa Bulletin released in June; (2) Update of July Visa Bulletin; and (3) July Visa Bulletin which has just been released today. This can affect the definition of "class" of the class action and latter two releases can fall under the two different classes. I wonder why the DOS is adding further confusion to the nation which is already in a state of extreme confusion and in despair because of their previous action.

The numbers are assumptions and NOT facts. Most of these numbers have actually been pulled from other places or based on some rationale (for example 750,000 from Matthew Oh site, 5 minutes/EAD based on what need to be done to print out a card and pack in an envelop)
Workforce of 30 though is a gross assumption. Bigger the number better it is. So we may actually want to question USCIS if there are any resource constraints.
Outsourcing is a perfect Idea! What do you have in mind Wipro at Banglore? :D
What about receipt notices? Isn't that teh first step? I do not believe it will take 20 months to get a receipt notice. Are you sure they have only 30 folks for EAD. Is that a known fact? What if it is 300?

Iam not jumping on the bandwagon but my wife and I are contemplating about opening a (indian) restaurant and I would like to know if we can open one on H1b/EAD status? I know I could consult an attorney but we are not gonna open it right away so wanted to get some insight from experts on this.
If we cant open on our own due to technicalities can we open it in someones name who has a GC or citizenship (my sister and her family recently got citizenship) and work in that resturant as employees, atleast my wife if not me.?

May be yes....applying greencard is required to extend the H1...having said that one has to spend huge money in applying for GC...at the same time one can also stay out of US for an year and come back if required...
I came to US when I was 24 years old...I delayed the filing and not a day goes by that I donot repent that...My friend are GC holders and bought their houses..I am 30 now..
I think that even at your age..a GC is good to have....It opens up many possibilities....Whatever money you save doing a job...I doubt that you can go back and retire..The prices of everything keep going up in India...One still would need to work....
Even if social security benefits get reduced in US, they would still pay something...In time if you have citizenship you can get whatever you can from that and whatever you saved would make a living...In fact if you donot have a concrete plan of returning in 1 year, file for GC immediately....
When this organization is successful, you would at least have a 485 filed and your spouse can work and they would not throw you out summarily...
