In Great Britain actually it is not only that the spouse of employee is allowed to work, but also a spouse of a STUDENT!!!!
Better not to compare that system with American - it's too depressing!

I was also told that there is new law which requires that the PERM fees should be paid by the employer (around 5-6k). Most desi consultancies used to ask the employees to pony up the labor fees. wonder how this will affect the conversion process.
It is ILLEGAL for the foreign applicant to pay for the PERM fees or the I-140 fees or lawyer expenses pertaining to either steps. The Employer MUST bear all expenses for this process. If you have evidence of wrongdoing, pls report it to DOL.
We should not be supportive of such violations of law - as a group it is not in our best interests.
The foreign applicant may pay all I-485 related expenses - or a generous employer can cover those expenses too.

FACTORYMAN. It is clearly stated in the rules of the NVC visa bulletin that scheduled A nurses are entitled to up to 50,000 "recaptured " numbers.... AND SHEDULED A nurses and PT are the only two occupation on the SHORTAGE LIST of the DEPARTMENT OF STATE!!!!!
Third: Skilled Workers, Professionals, and Other Workers: 28.6% of the worldwide level, plus any numbers not required by first and second
preferences, not more than 10,000 of which to "Other Workers".
Schedule A Workers: Employment First, Second, and Third preference Schedule A applicants are entitled to up to 50,000 recaptured numbers.
"if you can't be happy for others then you'll never be happy yourselves...your being self-righteous & "seem-to-know-it-all attitude" will get you nowhere..."
once again STOP ACTING like a CRAB!!!!!

Same sex marriage couples cannot sponser for GC?
But they can get Insurance coverage and family benifits from the state.
May be USCIS to prevent malpractice by the people to get the GC.
Wait a minute....are you saying that USCIS doesn't want ppl to falsify a perm residency application by faking a same-sex marriage and therefore there are no immigration benefits for same-sex couples?
Wow....let me share this with you: USCIS doesn't make up these rules; it stems from a US Law called DOMA - Defense of Marriage Act which only offers the 1,152 federal benefits of marriage to hetersexual couples.
The statement you make is rather disheartening; it implies that there is no falsification of heterosexual marriages today in an attempt to get a GC. It also implies that heterosexuals would fake a same-sex marriage to get a GC.... do you really think it is easy to fake any marriage? To what extent would a heterosexual man or woman endure and fake a same-sex relationship to get a GC? Be realistic, each and every marriage or "permanent partnership as contemplated by the UAFA bill" have to and "would have to" prove a valid relationship before a GC can be approved for that case by the IO at the time of interview.
This dialogue has veered off course from the main subject of this thread - I apologize for that. But sometimes sharing information can help enlighten others. Thanks for your patience with me.

Gurus,Is the above said true..please clarify...as it saves everyone who file renewals in 09 (esp. folks missed boat for 2 yr EAD)..

Agreed CIR benefits illegals more than us, and some of its provisions are flaky. But then it raises the EB cap to 625K and exempts MS + 3 yrs from cap. That in itself is a huge relief measure for us. Agreed illegals benefit a lot more, and the dems are more sympathetic to them but the point is we are not the choosers here. Something is better than nothing is the dictum for us.
Let us now stop re-inventing the wheel and re-focus our efforts to make the new congressmen aware of our situation. Have a nice day !
Actually I do have a convincing answer... whether or not that bill passes, we are in a lose-lose situation. I have read the bill (not in its entirety like I already stated). I know that the amnesty section already specified there will be no immediate granting of citizenship, excepting the wording for those who have been in this country for more than 5/6 years seems to imply they would get citizenship (again, the way a bill is worded can be twisted in future).
What I am worried about is, I get the feeling this is going to end up dipping into our EB3 pool... we previously had a Sched A for physicians and nurses that took numbers out of EB3 exclusively for them.
And I don't listen to Lou Dobbs or NumbersUSA rantings. But if you kept your ears open more than 6 months ago, you would also have heard some Dems says some not-so-friendly things about us.
One prominent Dem senator said H1-Bs are not suffering as much as illegals.
Another prominent Dem said this country needed more farm workers, not more IT / skilled ppl.
Have a nice day, anyway.

Well, it's time to break the news.:p I didn't attend the rally because
(1) the first and foremost reason: a recent surgey at my backbone , and I may not be able to walk for more than 15 minutes continuously.
(2) the second and honest opinion: Even If I were doing well, I wouldn't have attended the rally due to the yelling-nature of words from some of the Core leaders, and their pushy messages.
(3) the third and final point: The rally pictures and the rally experience of other members have impressed me very much and have totally changed my mind. So, next time, whereever you organize the rally, I will be there.:p
This is my honest opinion about my abscence. I hope noone will jump on me for my reasoning.
Regards,
IK
do not want to jump in here but inskrish disappoints me very much.
i have engaged with him more than once. he complains about someone or the other being rude on a non-stop basis. i would like to hear from him which core members has yelled and posted pushy messages. most of us desist from such actions most if not all of the time. actually he probably has no clue who core members are. after all it's not announced on the July 2 filers thread. in the past inskrish walked around with a red square to his name and accused me of being responsible for it. maybe he needs to see how many comments he gets in his user cp. interestingly enough i may be responsible for the green. this kind of passive aggressive behavior is not going to be of any help whatsoever to us.
i'm glad to hear he has a change of mind. but i will believe it when i see it. so far i see no change in the constantly complaining-accusing tone from him. words matter. constantly putting down others and acting superior is not constructive to an effort that is voluntary- each one of us- and certainly you franklin- have given up a lot to push this effort forward. words from the likes of inskrish do make me wonder why we bother.

Hi
I am trying to donate $50 but every time I go through the "Donate" link it takes me to paypal site, where it says that the transaction could not be completed.
Did anybody else saw this problem?
Can I simply send the money to donations@immigrationvoice.org? The last time I contributed using paypal this was the email address that the money was sent to, the business member id was 878.

Do you guys think its worthwhile to go back instead of trying waiting for the retrogression to end. From the looks of it, i doubt there is any chance of an immigration bill before the elections. if there is no bill then we will end up waiting for 8-10 years for the dates to be current.
if they remove the US masters from the quota, imagine the rush it will cause in the universities, effectively it will imply that you will get a green card after you study for 2 years in US. take a 20-40k loan and get a GC. There is no country quota for F1. i had friends who were rejected for F1 because they were 'potential immigrants' wonder how this theme will play out in future.
from this shore returning back seems to be an alternative worth considering...or maybe its just todays depression talking.
Another perspective is that if people with Masters or higher degree are exempted from the EB quota, it will in fact help in moving the priority dates current, since there are lot of people in wait who already have advanced degree from US universities and won't be using up the visa from the EB quota.

Ok so we have a place in mind?
I suggest Troy. It will be center to all?
On 10-20 at 10:00 Am we can meet at Troy recreation center. This is on Livernois road, between Big beaver and 17 mile(wattles).
Or if you have more fitting place in mind, please suggest.
All that can make it, please update your personal information on your account here.

If you are talking about IT then to code in Java or VB you do not even need Engineering degree. Any guy with basic education can do the job with equal ease.
I think Eb3 people are still finding it hard to accept that it is only them resposible for being in EB3 blaming any body else will make no difference.
even though I am in EB2..from my personal experience, the kind of IT contracts/jobs/assignments we (most of us) do, I dont think there is anything that an EB2 qualified can do which EB3 cannot do.
I saw threads (this site or elsewhere) where EB2 ppl felt superior and blasted the threads where EB3-EB2 conversions were discussed.
IMHO, I would always say, if it is legal and possible and beneficial, ppl should think of conversion.

I am one of many many and happy to see this development.
I am puzzled.
Just would like to remind you all , only couple of months back, there was a great optimizm of CIR .. but today we know it is in stalemate.
So I think this time around we should be cautious. I have a question... What is the gaurantee that this bill is not to increase H1-B alone? Sorry If I am not being optimistic here.
I request, Our web faxes clearly state why we support SKILL BILL... If I read right and remember it well, this Forums goal is to reduce retrogression/backlogs.
Now to be positive I am copying an extract that was in quotes in press release ..
“To our detriment, current policy mandates that we educate and train these brilliant individuals and then send them away to other countries to compete against us.”
Thank you IV for your efforts.
Excellent Point. Its defenitely not in any of the employer's interest to worry about EB issues. Infact they prefer people being in H1. and I certainly do not want to support that. There are good chances that congress increase H1 quota and we end up supporting the wrong cause. As far as IV is concerned, I would even go to the extent of saying that we should not support H1 causes, as there are enough candidates in H1 here undergoing EB problems. Thanks for bringing out an excellent point regarding this bill. My opinion is, if EB issues are not stressed properly, this bill will be viewed as "INCREASE FOR H1B BILL".. my 2 cents.

Thumb-up for the DC Rally! I think our efforts will be long-term. We got to get the idea across to as many people as possible. Rally is powerful, but we also need to use other types of campaign--big or small to get our voice heard.
One idea my American friend shared with me was to make presentations at retirement centers or community centers/ events. We need to be visible and our contribution to the country made known.
Wonderlust
Hello guys!
I wanted to volunteer a thought that had been in my head, so I am basically thinking out loud here for a bit, just throwing this out there for your guidance, tell me if you think this is too aggressive, or even premature?
I think we need another rally before the end of the year. There are 2 reasons:
1- Presidential campaigns: After this Fall, presidential campaigns will be in full swing, and thus commanding all the attention of Congress, the media and the American public.
2- Memory: People's memories are short. Now that we have the attention of the media and Capitol Hill, wouldn't it make sense that this is the time to redouble our efforts and push harder? If we wait, the iron might just cool off.
Having said that, and as we know, a rally means a lot of money, a lot of work, a lot of dedication to organize. Yet, no one said our struggle was easy, and other people and groups who have gone through tough struggles have had to go through extraordinary lengths to achieve their goals.
So, if we were to hypothetically hold a second rally this Fall, we could go for the "low-hanging fruit", i.e. we can hold the rally where the most of us live, such as Silicon Valley (and we know those folks really come through), we can plan to reach attendance to this event in the tens of thousands. I know we might not have enough time, and the people who worked so hard on the DC rally are probably exhausted. But, what if we just focus on an area where there are a LOT of us, and do a "no-frills" rally? Just get the police permits and show up. Our numbers will do the rest.
