I would love to attend the rally. However my financial condition at this time does not permit me. I could have booked a ticket on my credit card but all my cards are max out!
You want to know why I am in this financial deep hole? Well, I have two sons in college and paying out of state tuition, that is over $17,000 per semester for both of them.
My wife on H4 could not work until now that she has an EAD. It is retrogression that I should blame and I would love to do all in my power to obtain relief or bring the issue to the attention of the American public.
In my own way I have contributed to IV both in cash and in kind. I have told me story in countless media interviews. I only wish I could do more for IV financially but alas I am not able to do that at this time.
I would be in the rally in spirit....only I wish I could attend in person.

Hey, mine is EB2 ROW - can't get any more straightforward than that, I-140 is approved, and PD has always been current! Well, 1 year 7 month and still counting. It would be really easy for me to blame USCIS inefficiencies, but let's look at the whole picture. My second H1 was approved in 1 day (premium processing), my I-140 was approved in 9 days (not premuim processing), I got my fingerprint notice and RFE on I-485 a month after I applied - that means the case was looked at, determined what else they needed, and everything was processed. Work on my AOS case was over 4 month after applying (and I did apply concurrently). Then, I had to wait for namecheck... and wait and wait. Do I blame the processing center for that? No, it's not their fault. Do I blame Chertoff for that? Sure! He is the one who's supposed to negotiate things between DHS and FBI, and make sure things work well together.
Now, we come to a different issue - quotas. It is obvious that USCIS is not good at all at managing quotas. I am in management, and to me the task of getting within 100-200 approvals on 140,000 quota does not appear Herculean. It's a very predictive process, so theoretically it should be easy to get to right numbers. My take - USCIS system is built in a way that does not allow them to understand and manage the flow of petitions - and forecast how many will be ready for approval in any given month. That's a big flaw, but you know what is the best way to fix it - to relax quotas. Then, they would not have to triple-check every petition to make sure it's current and it is its time to be approved. Having quotas adds a lot of complexity that CIS can't manage. If you look at the immediate family petitions, that do not have quotas, they are getting approved in 3-4 month, so one part of the system works fine, and the other does not.

The DOS after consulting with attorneys and the Congress has concluded that EB visa numbers should spill over horizontally rather than vertically. Relevent legal clauses addressing this issue were posted by IV members yesterday. DOS now admits it's previous interpretation of vertical spill over (excess visas going to EB-3 ROW) was wrong. Can it be challenged or reversed?, Of course possible but very unlikely to happen in the near future in the next several months.
All said and done, I'll say vdlrao calculations with (sumagiri correction:) look credible.

I dont know how they are going to deal with immediate family members in that scenario. This does not sound like a bad idea but not everyone is lucky enough to afford doing their Master's in US. A number of them come on H-1B visas. Bill Gates was not against H-1B program.
I think there is a general consensus that H-1B program is being abused by employers. IEEE is suggesting to wrap it up while others are suggesting to keep the program but fix it, by providing the flexibility based on the current market needs and enforcing tough monitoring on the employers.

There is so much hypocrisy in the media. If women vote for Sarah Palin it is wrong because you voting her just because of his gender. But oh, if you are black and dont vote Obama, then you are the most odious person living in this world. How will you explain your kids that you did not support a black person for presidency? This kind of duplicity is keeping Obama look good in the eyes of people. Throw off your goggles and you will see the same issues with Obama that you see with Sarah.
Also, so many low intensity criminals are asked to do community service, that does not qualify them to become the president of US. And what happened to his moral fiber when he changed his opposition to the telco immunity bill and voted so that he does not look bad on security issues? What people don't seem to realize is that it is extemely difficult to get an H1-B if you are from a Humanities/Liberal Arts background. I'm a teacher and there are jobs in my field...the only problem is that school districts/community colleges/universities are unwilling to sponsor H1-Bs!

To any member who has been looking at some of the posts since April/May of this year it will be apparant that there has been an attempt by the ultra conservative, anti-immigration groups to create a divide among legal and so called illegal immigration issues. It was good to see that most members perceived this and stayed away from singing the legal vs illegal immigration tune.
Now comes the lame attempt to play on your fears again. What would happen to you if all these so called "illegals" were to get in line ahead of you? The knee-jerk reaction is so obvious. If you see deeper, you will find that all this is but wenting of frustration by the anti-immigration groups on their major loss in the recent elections.
There is a precedent for this behaviour. After the CIR was passed in Senate in May earlier this year, these same anti-immigration group members posted so many inflamatory posts that created a bad vibe on this forum. Well today is a redo of that. Just count the number of posts and you will know what I mean. ;) I urge all members to look at the new ray of hope provided by the change in the new congress and ignore attempts to dampen your enthusiasm in garb of fair and balanced aka an anti-immigration spin :)

I have just called the USCIS. They told me that the applications will not be rejected but just put on hold until our visa numbers will be avialiable ifor the nerw FY 2008.
In addition she told me that the Nebraska office is sending back the filing receipt to the applicants which it should not affect our h1-b visa status in case we are going to travel.
For the last part I do not believe her. Is there anyone else that can confirm that ?

Too late in the game. Lets just finish up what we've started. I believe in go green (I pledged not to buy another box of ziplocs) , but if 25000 sheets of paper will bring me my fixes, I don't mind planting 20 trees to make up for it.

Hi Guys...
Here is 100 more from me through Paypal. I was excited to learn that there is another bill in the works that supports converting the 55,000 visas to advanced degree holders. That will free up a lot of visas in the EB-2 category and also some in the EB-3 category.

I am a july 07 filer, and now its time for my AP renewal.
I would appreciate if experts can give me suggestion regarding the AP Process?
or point me to thread having a information, I remember in 2007 we used to have a thread/blog with screen snapshots for AP filing.
My 485 is in Texas Service center.
1) ANy restrcitions for filing AP Electroncially
2) Fees
3)If Paper Filing do I have to sent seperate cheques for me and my wife or a combined cheque.
