I totally agree with you days_go_by. The US immigration law sucks. One the one hand they will keep on syaing that we have shortage of manpower and on the other hand they try to restrict. Every single head counts....even the persons on H4... H4's can also contribute to the economy...rather than a simple HEAD Count in this country.

I called the USCIS just now, and they told me that they can tell the receipt number to ONLY my attorney or my employer, provided its already in the system. I filed on July 5 ( NSC), and hasn't got the receipt number yet. There is only one person in my company to handle hundreds of GCs, and the person is very busy processing all these I-485s, and will not pick the phone for any enquiries, no reply for emails etc. so i am stuck! so i dont know whether they encashed the check or not!

When I said that there should be one Item in IV agenda to Ban Porting, everyone got mad.
I still say that they should be allowed to port but should go back in line. they are disturbing the balance. I am not against them, if they were EB2 candidates why they didnt file on EB2 category at first, if now they think they are qualified then they should start new process.
BTW. they will create a big retrogression for EB2 then EB2 people have to port to EB3

With what happened last July, it will be a long time before we see "C" on EB3. However, we can only hope that atleast the date listed is closer to date.

Its reg the point system. We get points for employer sponsorship and number of years of US employment right?
1) If a person has been working here for 4 years on H1b in STEM decided to leave to canada this week. He then comes back lets say in 2008 or 2009 and then wants to apply for GC. Will he get points for the previous 4 years, even though there was a break in service (canadian trip) for 1-2 years?
I need to know this because I am contemplating moving to canada (my current employer has filed for LC, which I will then be nullifying). Ofcourse I intend to renter after 1 year or so.
2) My seccond question-- I am also planning to start a new GC before leaving to canada. Can GC application proceed while you are out of the country? If so until what stage?

I think USCIS will make the dates current as long as they can see in which category people have filed most after last july( if both EB2 and EB3 has large number of filers they may make both current as last july), so that they can get the increased fee from a "substantial" amount of people filing, and give them EAD and make the cateroty to "U" after the filing:D

Thank you everybody that has contributed. We need to raise $50,000 in the next 15 days. That is $3334 raised every day. Now even though this looks like a big amount to raise, with a collective effort we can do this. This is our chance to make this happen for ourselves. Let�s say I receive my Green Card in couple of months .now my situation. Right now I am on EAD, Single and EB2 current. My friend has a similar situation.
He transferred H1 to Company B and worked for 5 weeks and descided to come back to company A (He is 100% sure that Company A didn't revoke / calcel his H1 and he has valid H1 till 2009).
IS this OK?
