I am in almost exactly the same situation as you... I wonder if this can be done as well... On the other hand, as long as AC21 and EAD are prevalent (as long as we can indeed get 3 yr EAD) it is atleast not as bad for us...
I pity the poor guys who could not file in july for whatever reason and are stuck in EB3 with a later PD
Yeah agreed...atleast we r lucky in that sense. But looks like now EB3 is not going anywhere. I might be wrong but till I dont see some good movement in EB3 category I choose to remain pessimistic...

I guess it depends... I would prefer to slog with weather in Canada for 3 years and get citizenship instead of stuggling for 4-5 years with desi consultanting company to get GC. My sixth year is about to start in december 2009 and employer has told that they will not sponsor GC. I am planning to take citizen ship from Canada and then move back to India. That way, anytime I want to come back to US/Canada doors will be open. I guess, there is no right or wrong answer, its a matter of choice.

Unless Congress provides the necessary funding for managing the millions of applications under MBS along with Y visa, Z visa, new family based petitions etc etc, anyone would agree that the total time to get a green card will not be less than 9 years regardless of how many points you have or how early you filed for ur GC.
The current gc backlogged applicants have already gone thru 5 years of never-ending wait time - this will increase by another 9 years.

Hello,
I am a Canadian and have a PD of 3-05 LC apporved 10-06, filed i140 in 5-07 and am putting together the documents to send in 485 application this month.
I am on the 7th year of H1-b but have extension valid until 2009
In a few months I won't have a job. I am trying to apply for 485 before it ends.
Is it possible to find a job that is different than my current job description?
When I look for a job, what to I tell potential employer? do they need to sponsor the H1-b or Green Card? do they need a lawyer to manage my stuff?
What do I do after job ends? Does my family and I have to immediately leave? I heard that I can get a few months by applying for a different status (to take care of affairs) but that only get me a few months.
We were so happy last week , as our PD came up and we can go through the final stage to get GC... is all lost right now?
Would really appreciate some guidance.

This is not the SOLUTION!! It will only make things worser and worse...
If people keep converting their EB-3 to EB-2 then what about those EB-3 filers that file their application in earlier years? they will keep stucking in the line forever! THAT's not FAIR!
It is not the time to blame EB-2 or USCIS! IT is the time to dicuss an effective way to to distribute the visa no. effectively.

Everybody knows exercising is good. However, it is not easy to see the results of exercising. To see the results, you may have to stop exercising and then only you will realise oh, this is what exercising helps me not become.
If you want to sit and say, let the exercise show me the results and then I will do, well it's up to you. If you are happy the way you are , fine. But, don't knock the exercise.
Personally, I am not desperate about GC, so I never contributed except for 2 instances. One was a 100$ thank you gift for the SSN that came with EAD that got me additional 600$ tax refund. I felt IV has atleast has something to do with the visa bulletin reversal. Some may say, it could have happened even without IV, and may be correct.
The other time is 25$ for FOIA, where I was curious to get a clear picture of how many people are in the line before me.
Now, eventhough I don't believe in all other activities IV is doing , I don't go around knocking them down. I am sure they are trying to do the best they can and the best that they can think of. They always have an open invitation for people to join them and get involved. No, we don't want to get involved, get our hands dirty,but we want periodic updates and continuous progress.
Well, goodluck with that.

My experience has been similar,although I took the e-filing route for my wife.
Incidentally, e-filing is very convenient and takes less than ten minutes.....if you keep all the info ready. Apart from charging the right amount, the receipt also mentions where the application needs to be sent. There was some confusion when I was reading the paper-based form instructions, until I saw the receipt printout.
After e-filing, took a print out of the receipt and added
Copy of I485 receipt (I797)
Copy of earlier AP
Copy of marriage cert (I cant recollect why I began using it. This is the 3rd AP...renewed twice after the July 2007 filing)
Copies of the passport pages
Copy of I94
Two photographs
We mailed it on 16 Dec, and today it has been approved and mailed back.
It was quite exciting to see the 'post-decision' bubble being filled up.

At this point it doesn't matter who ever Attroney file the green card.
With the back log we have it takes several years to get the Green card.
You never know if you will be with the same company and Attorney for various resons like leaving the company on our own, company not doing good, lay offs etc.,
Join your hands with IV and fight for our Green Cards :).

Certainly Canada is much much better option. Wish people had talked about it 10 years ago. So for those who just came to America or those who are deciding where to go to work or to school, Canada should be the first choice. You will actually have more flexibility being a Canadian than American.

Thanks AskBird, My only concern is if the new EB2 labor or I140 doesn't get approved for some reason, can I fall back to my current EB3 application. I don't want to jeopardize my current application just by deciding to port to EB2. Any suggestions?

I read through your reply, however, I found it extremely hard for me to accept your points. You've been probably on EAD too long to remember what a dire condition you came from as an H1B worker. Let's look at it:
As an AOS, you can:
- Work for any employer
- Not work at all
- Travel out of the country without worrying visa delay
- When you got laid off, no need to worry about being out of status or restarting GC
As an H1B worker:
- If you are laid off, everything, years of wait, thousands of dollars, down the drain, and the whole family becomes out of status immediately. And in this dire economy, this is a sword hanging on the head of every H1B worker.
- Worry about re-entry visa each time you travel
With such a huge different, I can hardly convience myself that EAD is 'useless' or 'waste'. True, you'll need to work for same or similar job, but compared to the benefit, it is not nearly as big a problem faced by H1B workers day by day.

The prime candidate for USCIS to kick out people using EAD\485 is the same or semilar job restriction while using EAD\AC21. If everyone gets to pre file AOS without PD restrictions then USCIS will make using EAD as difficult as using H1b. Please fight for the removal of "same\semilar job requirement in AC 21" along with prefiling AOS so that everybody gets true relief and it really becomes a win win situation, otherwise it is a waste and will speed up uscis making life miserable for EAD workers.

People were very happy with the last USCIS announcement but we all forgot about pain of people who are stuck in years of backlog. Though some of those unfortunate may have used harsh or improper language, but they had all the right to express their feelings. We all talk about Gandhian philosophy, but we need to be more tolerant. Before we ask to ban anyone from our forum, please try to put yourself in their shoes.

from where would a child under 14 or a dependent spouse give I-131?
I haven't checked at this point, but I think I-131 is affidavit of support. Am I correct?

Only time people came here in masses were when H-1B program existed and quota was very high. So you reminiscing about your uncle and aunt(when H-1B never existed), and now talking about "masses" makes no sense. So don't make a U-turn on your chosen path.Now quota has reduced and hence the struggle for H-1B visas.
And who is talking about H-1B visas here, yes they are a privilege and not a right. iv is meant for people who have been sidelined due to unfair laws governing issual of GC's.It doesn't have anything to do with H-1B visa program and desi comapanies who misuse it.

Now, I have provided the reference to part of AC21 law with my interpretation, which allows visa portability (unofficially known as transfer) from one sponsor to another and excempt from numeric limits.
All I hear is "incorrect", "wrong" followed by individual interpretation or opinion. I respect all disagreement part, Which may be/not be accurate. Why don't you quantify your comments with references to law or CIS memo? Don't you think discussion need to be healthy and fair?
Now, I have a lot of filthy and rediculous offensive messages on the discussion threads with reds, which I would not like to post in public. If this is what our anonymous so called "highly skilled" can bring to the table, then I am speachless.
