Hi, I am currently on a Company A's payroll and working at a client's place (Company B); now that Company B wants me to join them; however, there is a contract between Companies A & B not to hire the employee directly; what should be done in this case? I also have a contractual obligation to my employer not to join the client for 12 months. My employer(Company A) is not willing to let me go (though I worked for a year already). Any advise from the forum?

PD Nov 2001 - Nov 2002 -> I would say no point in switching to EB2.
Labour + 140 will take atleast 12 months and another 6-9K US$. Not worth it because even otherwise you might have your GC within 12-25 montha from now.

Your calculations are way too optimistic.
If a regular IV member is spending 1000$ on credit card why cannot he/she not contribute 50/100 $ per month to IV. I don�t know about you or others but I use the credit card is gives best deal for the month for that month.
As far as contributing money to IV, again it�s not about monitory constraints but about making our self give some money for our own cause.
Well, If you sign up for IV credit card, the contributor is not paying from his pocket. It's the bank, who is paying for him, and contributor will keep earning miles/reward point as with any other credit card so it should make ZERO difference for card holder.
Its like finding a advertising sponsor for any of the IV event,except this is one time effort.

I think if USCIS start publishing the number of applications (based on PD of course) pending for each month, then we can predict our future and life will be much easier.
We are not asking for too much and I think IV can make it happen fairly easily.

It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher

I have no idea how you guys can even generalize something like this.
IT is vast; the spectrum vertically ranging from Networking, to Programming to Front end design and horizontally ranging from web based apps to system apps to distributed apps to enterprise front-ends.
I have seen guys in our field come to work with double masters, 11 years of very relevant experience and still struggle to grasp the intricacies of what we do.
As they say, when you know too much it is then that you realize how less you know.
If you think your job (read coding "hello world" for clients) can be done by somebody with lesser qualifications, you/your employer has committed an immigration fraud.

I saw threads (this site or elsewhere) where EB2 ppl felt superior and blasted the threads where EB3-EB2 conversions were discussed.

If the media holds Obama to the same standard as they do the republicans, you will see the democrats crumbling faster than a cookie.
There is so much hypocrisy in the media. If women vote for Sarah Palin it is wrong because you voting her just because of his gender. I liked some aspects in both, McCain seemed like a great guy with a great story (POW et al) I liked the way he initially backed CIR even though most of his party men opposed it; I liked the way he started supporting Bush when everyone else in the world is hating him and gave the support for troop increase. But of late his campaign has become sleaziest...all lies. They took one vote of Obama out of context and say that his only contribution to education is sex education in KG. They showed Obama as the reason for increasing gas prices etc. Even I can see how idiotic these claims are and McCain is still supporting them. Then his whole equation with Bush - he is using his connections for fund raising and accepting his support but publicly acts as if he is running against Bush. This whole republican propaganda machine projecting Palin as next best thing in US politics is laughable. She does not have any experience and whatever little experience she has - she seems to have abused it. Well she does look good and seems to have fired up their cadre - that is good enough for them. Of all McCain's shortcomings - his choice of VP is most horrible - its a purely political choice. Nobody is complaining about women voting her (actually none of women's organizations vote her as her extreme right wing opinions) - the problem is republicans wants people to stop thinking about ISSUES and think who is reposible for this state and think about who is better to solve them - they just want people to think about pigs, lipstick, moose, sex, kindergarten, etc and vote enmasse to Palin (note they gave up on McCain already that is why this sensationalism on a VP).
Obama side - yes he is inexperienced (and infact I liked Hillary during primaries) but atleast he is running a very honorable campaign and convention. He is atleast talking about issues. The notion that journalists are light on him so .... over ... and so primary time theme. If there is a Palin like issue on him (say he is involved in firing someone; or exaggerating facts about her opposition to bridge to nowhere; or even about family with a teen-aged pregnant daughter) the press would have been on fire just like when Rev.Wright was an issue. So dont say that press is light on him. About the race - you may not see everything open in our offices but yes his race is a main reason why he is still backward in polls if Obama with same policies and same charisma and same experience level and background is a white guy he would have run away with this election already. Whether we like it or not race is a factor and it works both ways. The thing that I dont like about Obama is the fact that dems are still didnt close this thing - the state of economy, an illogical war, an all-time low popularity of incumbent president who belong to other party - still thing is not closed. I truly think that it would have been different if Hillary is the nominee.
About whether community organization is a reason enough to become president - on the same token we can ask - whether crashing your plane in a war is reason enough to become president. Ofcourse not - both of them have enough strengths to came to this point than being onetime organizer or onetime POW. As someone in the sidelines - I like them to see to run this campaign in a honoroble way and discuss real issues rather than rake up silly/idiotic/dumb/fake issues. Both initially seemed promise in running campaigns in that way but of late McCain/palin went off the line and its slowly becoming a mug-slinging match. In that respect I started liking Obama more.
On immigration related issues - especially EB related issues - I think none of them can make a difference. We need something to be done in congress and personally I think that probability of something happening next year is very low (that is why HR5882 is so important for us - its right time and if we miss it we have to wait for another couple years maybe).

(14*50)/(0.02) = 35000
Sure there may still be 2002 files waiting but it is definately not a GREAT number. Here are three logical bullets to conslude that.
- Many people with 2000/1/2 dates have already left USA - Tired: Could not
take the delay:Found good oppertunity back home or elsewhere
- Black labor market played a part to shift a considerable load either to EB2 or
PD date from 1999/2000 and thus many people preferred that path either

Yes that is true. They are lobbying strongly for H1b though they are supporting GC increases. Actually with H1b you can stay unlimited years if you apply gc. So there is no urgency for corporations to resolve the issue. They do not have fear of losing you as you are going to stay in USA until you get green card

Hi,
I want to know weather can I apply AP for my wife while she is in US post it to India if she has to go to India before it gets approved.
As there is the situation my wife need to go to India in July and I am planning to apply for her AP, can I send it over to her once the AP is approved or dose she need to be present in US at the time of approval.

The visa office's interpretation is correct and if you read 202 (a) (5) it clearly says that the country limits should be ignored for unused visa numbers.
Well, which interpretation? The one from April '08 or from November '05? They substantially differ. That's part of the controversy. What motivated them to change it?
I do think that the interpretation is, at least, debatable, and I can see both interpretations. In the end, the question comes down to: does the country limit have priority over the EB category, and I don't think you can have a conclusive answer.
I have gone through the sections of 202 (a) (5) and 203 (b) and the text of the law does not say that prefer country limits over categories.
