That hurts to see so many people using IV for tracking receipts on the day of the rally but not participating in the struggle IV is putting up just for them!!
But know what I think as members we have really considered all of them as one..! I mean.. we should have given special attention to DC and the neighbouring states to fetch in max people.. 'coz we can depend on them for proximity..! we have majorly focussed on getting people from various states..well that again paid off .. 'coz news articles particularly mentioned people flew in from states as far as CA etc..
We cannot consider a person from texas or seattle to be the same as one in DC / VA .. Its definitely hard to convince to attend a rally .. how can we convince to take a day/2 off and travel leaving family and rest !!
Its sounds good and practical for some but many others will not concur!
I think we learn from our doings...! we should next time try and rope in as many locals as possible than depend on people coming from afar!

Its only going to take 5 people to break away from the 64. Those 35 "No" votes are the ones who want CIR dead NOW. They are not going to change. But those 64, its only going to take 5 people to walk away.
There are 24 amendments. I think atleast 5 people would see their amendments fail on the floor of the house and probably another 5 atleast who would withdraw support because someone else's amendment passed. This baby is going DOWWWNNN this weekend per my estimate. I could be wrong but again, 24 amendments ? That's too many darts on a fragile compromise.

i-140 has been previoulsy approved. I was laid off but my original employer agreed to give me evl, but with the way the economy is going they are not doing well.
I have another employer which I am working now with.
How likely is to get an approval (or an rfe for paystubs?) before 180 days.

Guys I need to tell you my story:
Last year HP acquired my company called Knightsbridge. Fragomen is HPs law firm. Everything was going well until we had this monster called fragomen deal with us. My I-140 was approved way back in 2006 and was waiting for a Jun-2005 PD to be current. In July 07, when VB was released, Fragomen suddenly found a problem with labor certifications of around 100 people. They had access to labors from Dec-06. Only they know what they were doing between Dec-06 and Jul-07. In june 07, the PD had moved a bit forward to 2004. That time Fragomen contacted a few employees to file 485. As soon as Julu-07 bulletin came out they suddenly changed their tune. The word "travel required for job" was missing from the labor. Fragomen advised HP not to go ahead with 485. All our arguments were falling on deaf ears. All independent attorney opinions were disregarded and HP decided to take fragomens advise and not to file 485 but to restart labor.
After my new labor got approved, I asked fragomen to apply for consular processing in my case. They tried to escalate it to various levels in HP and pressurise me to file I485. Finally I told my boss, I want consular and also picked up a fight with HP employee not to interfere in my GC process. Because this employee always sings the tune of fragomen. After this, they have not shown any interest in filing my I-140.
After restarting labor Fragomens service is generally upto the mark, however; they are rude and uncompromising, in that they will not share a copy of labor certification or I-140 with employee. To some of my coworkers they will not even bother to respond to him for his 7th year H1 extension despite numerious queries. One of my friends also got better than expected service in that they filed his 485 just 2 days before his PD was moving from current to retrogressed. That is the only one case I have seen with positive outcome in my company. Some employees from my company suddenly went into silent mode after July-07. I suspect, they were given under the table deals to go ahead with old labor. However I can not prove that.
After seeing all this behaviour, I have come to conclusion that Fragomen will give you good service if they see good potential revenue from you in future. Like EADs , APs etc, multiple H1 extensions etc. I think they are very money minded company and feel that they proactively advise employers to go slow on immigration and they also advise employers on how slow immigration could benefit the employer in the long run. They are completely unethical in my personal opinion. When they were describing the situation to our managers in Jul07, they were very insensitive and were showing as if nothing else had happened.
No one was held responsible for this fiasco and all good hard working people were left to suffer. Due to this I have come to despise fragomen and I also despise some big employers who use them. Here is the list:
HP, Cisco, TCS, Deloitte, IBM, ...... add yours to the list.

One way to think is; this forum is for people who want to do something about their state of affairs, and don't just hope that other's would fix the world for them.

Just imagine this, you spend 6 months training an international grad, spend $5000 - $7000 per H1B and after 1 - 2 yrs, you will have to start all over again. After a couple of months, the "new hire" will just be angry at you (just look at all the people on this forum who curse bodyshoppers - and just to clarify - I am not implying that the company you start will be a bodyshopping firm) and he will quit your company and join someone else. And you will have to start the process all over again. The guy who you hired on H1B will be now join someone else and depending on your business, you will be left high and dry.
I know this because the very first job I joined, the philosophy at the company was to hire fresh grads (the "get them cheap" works for American Grads too). My boss used to tell me "we can get two for the price of one". The year I got hired, the company recruited 15 new grads (a new "Product Development" dept. was being started) - and I was the only H1B. After 14 months, when the business started picking up, the company did not even bother to raise our pay or even recogonize us. Guess what happened? Over a period of 2 months, 12 of us quit for better jobs. Guess who now had to look for 12 people and at the sametime deliver the product to the clients on time?

The H1B visa belongs, in effect, to the company that sponsors it. You cannot work for any other company on that visa other than sponsor. If this is a transfer, then, In a so-called "visa transfer" what actually happens is that the initial visa is cancelled in favor of another one issued for the new employer. What that means is OP's work with old employer is considered as "unauthorized work". Do not consider this as illegal presence, as his legal presence is controlled by a valid I-94.

Again, gapala, understand this, if old I-797 is not canceled, beneficiary is authorized to work for old employer for I-797 validity dates. Sc3 and other friends. Here is what has triggered this bad blood on the forum
Apr VB EB2 is U and EB3 is doing well every one is normal exactly like every other VB no surge of threads and replies everything is normal
July VB Eb2 is in Apr 2004 and Eb3 is in U again every thing is normal
Aug VB Now suddenly Eb2 is 2006 and Eb3 is U ( no change) and all of a sudden there is a flood of e-mails complaining injustice against EB3. I think the timing of when Eb3 folks realized injuistice is what ticked off many.
I am not saying every one shares this feeling but just the sheer volumes of posting on this thread speaks for itself. I am sure many do not agree with me (or least pretent not to agree) Any one can query Eb3 injuistice posting before Aug VB and compare it since this bulletin was posted and see the data speaks for itself we do not need any body to prove anything

Just called USCIS and told her that My application was mailed on Jun 28th and it got delivered on July 02. I also told her that my PD is May 2003 (hence i'm eligible to file in June)..
She told me that since i mailed it in June and this Notice goes into effect in July 02 my application WILL NOT be rejected... She asked me to wait for receipt notice :)

Reading through this, this only says that the status cannot be changed (to a PR). It does not say that the prefiling of of AOS application cannot be done.
I think we should definitely try to work towards this. There was also an article on Immigration daily (http://www.ilw.com/articles/2009,0225-endelman.shtm) which suggests pre filing as a administrative fix that will solve a lot of problems.
I am definitely in for such a initiative.
