I replied to the EB3_Nepa's first post saying that we probably should support killing this bill and try to attach our amendments to other bills.
And then I saw posts from others saying there were 700000 faxes from anti immigrant groups to kill the bill. And we barely managed to send some 10000 to 20000.
Like someone else said we seem to fighting their huge swords with our toothpicks. With a member strength of 14000, we will not be able to fight their web fax camaigns with any bill this year (even appropriations bills etc.).
So I come to this conclusion (which IV pundits probably arrived at long back) - the only way we can fight the anti immigrants is by aggressive lobbying. We have only 14000 members, but we together can contribute like we are a 700000 membership. And then we could think about hiring more than one lobbying firm if that helps, otherwise apply more pressure through the one we currently use.
This is the only way, I feel we can get anything done this year, because increasing membership takes a longer time than raising funds, and we dont have time!!!!
I completely agree with you. We have not come all this way just to look up at the sky and say "Thank God, the CIR failed" OK. Dont know how many hours / money the core members could have put in in washington or otherwise regarding this bill. I firmly believe that failure of cloture of vote was part of the lobbying effort too. If eveyone wanted to just get this passed in the current form, then why did the vote fail? They know there needs to be key changes and thats what they will now work towards. Now neelu whether you are UGA / sharma's lab or not, I completely agree with you.

I'm also EB2, BEC, PD Aug-2004. Still waiting from my GC.
Are we assuming that all the BEC (Backlog Elimination Center) EB2's have already gotten their GCs..?

It is better you do it online and mention that you have pending 485 in NSC. I don't think Fl has anything to do with your place of sending.
Once you file online you can get a print out of it for your reference after you pay and USCIS will send you a receipt notice stating that they received your AP request. If they need any further evidence they would send a letter to do the same. Till then just sit back and check online.
I filed mine online and they sent me a notice saying that they would require my latest passport size photo, which I sent two weeks back and now I can see that it is in process when I check online.

I was told by my attorney NOT to do this...Apply either through yourself or through your spouse. I was told that if there are two different applications for the same person, then it raises a red flag and you might end up in a big soup...But having said that, your attorney(s) might have different opinion(s)...
With the good news of all numbers current, both I and my wife's dates are current and eligible for filing I485.
1. In my application, can I include my wife as spouse for adjustment of status? And In my wife's application, can I include myself as spouse?
I am trying to do this to make sure if anything goes wrong in any one of our application, I can depend on the other one.
2. If I get an EAD based on my wife's application, can we both switch jobs after 180 days and take advantage of AC21? I read in some forums that I can, but the primary application (my wife) has to work for the same company until we get I485 approved.
Thanks for your answers in advance

Thanks everyone for your contributions. We need support from every IV member to succeed.
If some of you have an innovative contribution idea like the last time. (setting small goals and contributing based on that or giving gifts to people when a target is reached) please go ahead and post your pledges on this thread. This may help the momentum of the funding drive.

Its good that at least some of us are getting VISAs, instead of VISAs being lost.
However if this continues we could see a big movement to switch over to EB2 with or without porting PDs. This may in turn help EB3 :)
We need to make this a sticky thread, so that we can brainstorm and put best ways to switch from EB3 to EB2 w/keeping older PDs.

Transfer of the Earlier Priority Date : EB3 to New EB2
MurthyDotCom
The ability to transfer priority dates from an earlier, approved, I-140 to a later-filed I-140 could provide an alternative for job mobility, both within the current employer's organization or with a new employer. This would be helpful for those who want to make a change but are not eligible to file the I-485 application because of retrogression. It also could help people who are eligible to change from an EB3 classification to EB2. One would be eligible to request a transfer of the priority date from the earlier-filed EB3 petition to a new EB2 petition once the I-140 is approved. The new EB2 petition would need to be based upon a new LC for a position requiring the EB2 level of education and/or experience. (Over time, many people with EB3 cases have become eligible for EB2 cases due to increased experience and/or education, and promotions.)
This strategy potentially could shave off a few years in the queue for available immigrant visa numbers. This may be particularly appealing to those who had EB3 labor certifications filed on their behalf long ago and have had their cases pending while they have gained advanced degrees, acquired several more years of experience, and/or are offered jobs at higher levels. Keep in mind, though, that this involves filing a whole new LC under the PERM system for a new job opportunity and that the employer must actually require the additional degree and/or experience for all persons holding that job classification in order for the new case to be filed as EB2.

How about Cyrus D. Mehta & Associates?. Please share your comments about this attorney based in NY.
gee_see, Cyrus Mehta/firm has been handling my F1 to H1-B filing and GC processing; I have had a very positive experience with the firm, no complaints.

But Why do you feel the bill would not pass.
If they had used up enough visas...why does it have to be still in Nov 2001.This is insane.Total Insane prediction.
We should not read these type of predictions.
lets be positive.we have to beleive if thats in IV only.

TheOmbudsman,
A number of IV members have complaint about your posts. We know that you have earlier posted on IV forums with the screen names Communique and marlon2006. If I remember correctly, your handle 'Communique' was banned but it was pretty clear that you were an anti-immigrant. I want you to read this post because in next 15 minutes, I will be putting a ban on your handle.
Immigration Voice forums are created for high skilled immigrants and their families. We contribute constructively to the society. Your hate mongering tone and disguising as 'someone waiting for green card' is pathetic example of how low you can go. I try to read forums everyday and I try to read each and every post. Each day I try to read your post to get more determined to continue to work on this very important issue. But now, I think its time for you to leave IV forums as your tone is again becoming offensive and your posts drive legitimate IV members away.
We are requesting you politely to please leave IV forums alone and do not bother IV members.
Thank you,
WaldenPond
I assume that this reply goes to anyone, who is doing this kind of mischief in this genuine forum.

Unless Congress provides the necessary funding for managing the millions of applications under MBS along with Y visa, Z visa, new family based petitions etc etc, anyone would agree that the total time to get a green card will not be less than 9 years regardless of how many points you have or how early you filed for ur GC.
The current gc backlogged applicants have already gone thru 5 years of never-ending wait time - this will increase by another 9 years.

Sorry guys, I was in India for the last 2 months...family issues..etc...but congrats on a successful rally, I notice people are talking of another rally, here are my 2 cents :
1) Although the rally made news, the fact that ONLY 1000 people attended is not enuff for national coverage and common man- news.
2) A second rally should not just be one rally, it should be a rally across the country, every state, city, street. Fix up one date and one time where everybody in each state/city can meet, if you live in falls church and have a volunteer to organize the meeting, meet up there with some slogans, if u can do it downtown NY with even 100 people, thats great..but it all has to be co-ordinated, just think of the impact if at 2PM EST, 11AM PST and 12PM CST on one particular day... every legal immigrant worker is on a rally and this gets publicized..i know it sounds far fetched...but little wonder, the illegals all gathered up in large numbers and were able to get legal in 2003-2004....can we educated folk learn something there ?? i can volunteer for my area (west coast, southern california)..any takers ?
