chaanakya, why do you have a problem with the donors? if you don't want to make any monetary sacrifice that's fine...nobody's complaining. Now it's only fair that you don't complain when people making additional sacrifice are given some recognition. Don't mistake...those donors also make all other forms of non-monetary contributions. Have patience things will work out slowly but surely.

The problem is, that for all my efforts, people just don't seem to care. The only reason I had any success was the embarrassment I caused the government because of all the soldiers who were excluded. Immigrants in the US are viewed by most people as an unwanted scourge.
My employer has also been no help at all. I have been looking for work outside of the US, but unfortunately, the economic situation makes that a bit more challenging. Sorry if I sound pessimistic. That is just my personal experience.
I agree but that should not keep us away from trying. If it were not for HOPE then a lot of things would not have worked for people including the newly elected president.
I understand the frustration but at least we can use the same info and make it available to the relevant authorities. I think we will not loose anything as like last time we will be dropped again.
I am willing to contribute sometime to it. Any one else interested?

I agree 2001 and 2002 was really bad job market and not many new labor filed. But things started getting better end of 2002/2003. And I know many of my friends filed EB3. Later some of them got substitute labor and got their GC in 2004/2005. So not really sure if it may go forward that faster 2003...2004...I wish it does.

Sorry to be rude guys, but if you are a new EB3 India. "post 2005 perm". I would advise you to seek greener pastures in UK or India. I dont see a light at the end of tunnel as things stand today

This is the most stupid thing i ever heard. sorry if i offended you by saying this, but i myself wish you should be first in the line than me. We(most of us whose pd is later than yours and most of you guys) wish sincerely that you people should get GC before we get. No one opposing your cause, but we are asking to think one more time whether you'll get any benifit from this. IF YOU THINK "YES" PLEASE GO AHEAD, but dont curse or use any kind of bad words, not appreciated.
Very few members of IV are stucked at backlog, so what i suggest is talk to core personally about your cases, ask them to help you guys in finding out what happened to your cases, if a person with pd 2005 got approved and 2004 is stuck means there might be some problem with the case filing, if not yours, your attorney might have done some mistake or so. so i personally think you should talk to core and find a way to solve this problem.
Although, some people may call it SELFISH AGENDA and advice not to use IV platform, I strongly support the cause. Some people may advice that once the labor is cleared, people with 2001/2002/2003... PDs will be at the front of the line. But, when those old labors are cleared, will they be able to apply for I485? DOL may say that by September 30 the backlog will be cleared. Is there any gurantee? Even all are cleared, they will not be able to apply for 485 now (has to apply by August 17). I think some SELFISH people with recent PDs are scared as people with older PDs may take the quota.
Regarding IV platform, it is an organization for the GC sufferers and by the GC sufferers. So this is of course the right place. If IV is busy with other issues, then people have to start their own fighting.
I am neither sure about the legal complications nor have any idea about the legal fees (or who will pay it) etc. Better consult attorneys about the viability of the case.
BTW, my labor is not in BEC and I have already contributed $500 to IV.

I have been member of IV since Dec 05. Probably since a couple of weeks after it was founded.
I fully agree with Logiclife . All these people can't be termed anything else . "Cowards" correctly describes them.
I see people all the time worrying about their receipt notices, fingerprinting , india trip, stamping , I-94 , EAD , AC - 21 etc etc etc .. it makes me sick. No one contributes ( except a few 1 % ) . Even if 10% of the people contributed either financially or doing volunteer work we would make a worthwhile difference .
I don't much care about GC but seeing these people it seems like if they got a GC they will get a magic wand and somehow it will be the end of all that is wrong with their lives.
Guys sitting at the fences and lurking in shadows - GC is not the cause of whatever is wrong with your life.. you are . You remain what you are with or without GC.
But for the rest of us lets not lose hope on these guys. Lets do what we can and be patient. We should do our best and hope for the best.

I have used Fragomen in two different situations...
1) Contracted by my employer. This was frustrating from my perspective. I felt a little like an object, mostly dealt with paralegals.
2) Contracted by me. This was much better, I could call the attorneys up anytime, and get an answer when I needed it. Had excellent relationship with paralegals.
These were two different departments.
I do think that I suffered from some less than optimal advice, filed EB3 when EB2 would have been better. That was in 2002 when EB3 EB2 EB1 for all was current. EB2 was a tougher sell to Dept Labor, but I think would have worked, attorney didn't want to risk, and wasn't sure if a downgrade would be offered if EB2 failed.
One thing was consistent.... expensive.
I all but begged them to send out an email to clients referencing DC rally.
I have raised the idea with core of adding a field(s) to profile giving attorneys name/address. If we have a lot of members with Fragomen, maybe we could write a group letter asking them to send out a mass email to other clients.
So please be civil in these public forums.

Could not agree more. We are masters of everything related to caste, quotas and discrimination and we need to fix our own house before complaining about other countries, airlines etc.

Some non-IT companies would not sponsor H-1B visas because of unwanted complex process/paper work or they can not compete for visas filed left and right by big companies. The job is not going to wait for the visa availability. Please stop nonsensical, insensitive posts without knowing the reality and frustrations.

It's true that Democrats tend to be pro immigrants a bit. However, most of their backers are labor unions, which obviously don't want to see any more labor here, legal or illegal.
How will these forces play out on the floor is anybody's guess. We've seen how a Republican congress works. Let's see how a democratic congress will. I'm just a little bit hopeful... same as 12 monts ago... not more... not less.

PD Nov 2001 - Nov 2002 -> I would say no point in switching to EB2.
Labour + 140 will take atleast 12 months and another 6-9K US$. Not worth it because even otherwise you might have your GC within 12-25 montha from now.
PD Nov 2002 and beyond : Have to actively consider switching to EB2. Myself being in this range, I am doing the leg work and waiting to hear on what happens to the recapture bill. If it does not happen then these PD's should switch if they can and qualify.
Instead of being jealous towards EB2 bonanza , I think EB3 applicants should make use of this Eb3->EB2 conversion option and participate in the bonanza.
Yes, it costs additional 9K . Consider that the price of the ill advised decision to go in for Eb3 to begin with.
An opportunity to get past this GC mess and start realizing your dreams on both personal and professional front.

Please Ignore people who are obviously here to create confusion and to discourage and bring down the general morale. It causes a drain on the energy of the *Volunteer* Core Members. We should never lose sight of the fact that this is the one and only Forum that has our goals as the Priority and it is the *Volunteer* Core Members who have taken the initiative to try to get something done. The very fact that we have this Forum and that we have a coordinated effort to try to get some thing done to address our issue is worth the money that I have contributed and will continue to contribute.
What will I do with a few extra 100's when I have no security?
Folks please understand and support the effort. Be Positive and keep the energy effort and drive UP.

what I meant is the following. There have been for years visas for skilled employees, one is called L-1 and is when a person is transferred by its company, the spouse can work. the other one is H-1B hired by a US company, the spouse cannot work. Then now, they are about to legalize people who had been living illegaly in USA doing low skilled jobs, they will give them a low skilled requirement job visa, exactly as the H-1B and the L-1 only that the skills are low, and they will let their spouses work also, the only spouses of non permanent resident aliens with a valid working visa unauthorized to work will be the H-4s, and it is not fair.
