Hi,

I am renewing advance parole (i-131 form) for me and my wife. Can some one answer what the "class of admission" means on the form and how do we fill it?

I entered the US as H1-B but moved to EAD status last month.
My wife entered the US on advance parole and is currently working on EAD.

Class of Admission is the status you were admitted into US. You entered on h1b and your wife on AP and thats the class of admission :)

Tough talk from the Senate Majority Leader. Some, including my good friend Tamar Jacoby, think this is a really bad idea. I'm not so sure. I think fear of losing the Hispanic vote for a generation or more and the sudden urgency of the situation created by the Arizona fiasco could make responsible Republicans at least seek to block a filibuster and allow for a majority vote (as seems likely with financial regulatory reform). But Tamar is right that we'll get a better bill if pro-business Republicans play a role since some of the overreaching protectionist efforts of the unions...

Hi friends,

Today I had a LUD on my old I-129 (approved in Aug 2005). The online status say: �On August 29, 2007, the post office returned our last written notice on this case as undeliverable. This can have serious effects on the processing of this case. Please call 1-800-375-5283 to update the mailing address so this notice can be re-sent.�

I'm no more working for this employer and I�ve changed to a new employer a year ago. What does this status mean?Any ideas?

Does this cause any problem to my current GC process which was sponsored by current employer?

I resigned my job last year on Dec 15th 2006 by giving my employer a 2 weeks notice (dec 29th was supposed to be the last working day). A week later, i informed my employer that i won't be leaving them at which time, he suggested that i continue working as normal and that he would take care of un-doing the paper work. They had sent out a letter to INS to revoke my 797 even before my last working day with them. The HR contact has failed to follow-up and inform the INS of this development and am told last week that i have been out of status for 10 days now (March 10 was the day INS revoked my H1b). The company has accepted responsibility for this mess and are filing an accelerated H1b (premium) application this week. I had continued employment this whole time and never had any break in my payments. Are there any chances the INS won't put be back on H1 status with my company ?.
Experts .. please advice.

My PERM was filed on July 18, 2007. PERM got approved on July 26, 2007.
I-140/I-485 concurrent will be filed in first week of august 2007.

Which fee will be applied in this case ? New August filing fee or same July filing fee?

USCIS FAQ are confusing for this scenerio. I am sure lot of people are in the same boat. Kindly let me know what is the right filing fee for this scenerio.

All,

I wonder if more of you have noticed this phenomena: one of your applications gets approved, but the approval doesn't show up on the online case status system.

My AP was approved on Sept 17, 2007 and mailed out to my attorney who got it in a few days and told me about yesterday when I emailed about another issue. Oddly enough, even today (Sept 27), the online case status system shows an LUD of Sept 14 but no approval. I didn't get the usual approval email from the case status system either.

Annoying -- since now I won't learn of new developments till my lawyer calls me up to let me know and you know what slackers they can be. Although all this may be moot since apparently I am stuck waiting for my name check to clear, so there won't be any new developments to look look forward to for a long long time. Sigh. :(

Hi,

I filed for extension of H1B through my company A. I got notified today that my H1B filed was sponsored by sister company B. My GC was filed by Company A in July 2007 with PD of EB3 2004 December.

Would my GC process be impacted by this mess? Since GC process was started by company A, which would now be ex-company due to company B being new H1B sponsor. I am still on H1B.

Does it make sense to invoke AC21.

Please suggest.

My employer is willing to give approved labor which is better (EB2 ,PD-2003) than my labor (EB3, PD-2003) . But right now i am on 6th year . I got a 3 years H1B extension recently. Hi Folks,

Can I travel on a valid / approved AP when my H1 Extension is in progress. This is my
situation:

Valid AP in Hand valid till next year.
H1B expiring 6/20/2011
H1B extension applied on 4/7/11 have rcpt notice.

My questions are this:

1.) When I enter US back in with my AP in mid July will that impact my H1B extension in any way.

2.) Without any EAD will I be Jeapordizing my AOS in any way.

I will be continuing to work with the same employer who is the sponsor of my current
I485.

Request your thoughts and inputs on this situation. Appreciate any replies/advices you may have.

Last Friday was a depressing day for me. A businessman and his daughter visited me in my office. When I asked how they had learned about our law firm, they said a lot of flattering things about how "famous" we were and about our "great" website. However, when I analyzed their case, it quickly became apparent to me that nothing could be done to help them. It was too late. MEMBERS of Congress � with the possible exceptions of Senator Robert C. Byrd and Representative John D. Dingell � come and go. So do presidents and even Supreme Court justices.

But some big issues come to the nation�s capital and never leave, despite the politicians� best efforts to wrap them up and send them packing. Immigration is one.

Efforts to craft a grand compromise on the perennially nettlesome issue of how to deal with the millions who want to settle in this country collapsed in the Senate in spectacular fashion Thursday night, even though President Bush and the Senate leadership desperately wanted a deal. Almost everyone in Washington believes that America�s immigration laws are an unenforceable mess. But confronted with real legislation built on real compromises, the Senate sank beneath murderous political, geographic and ideological crosscurrents. Despite vows of senators to resuscitate the bill, it may be months � or years � before Congress again comes close to passing a major overhaul of immigration law.

But immigration is only one of several major policy matters on which virtually all Americans agree that something has to be done, even as Washington seems mired in dysfunction. What will happen when Congress turns next to energy legislation? Or global warming? Health care? Social Security?

It sometimes seems that it takes a catastrophe to create consensus. The Great Depression, Pearl Harbor and Sept. 11 all shattered partisan divisions and led, at least for a time, to enhanced presidential power and a rush of bipartisan lawmaking (some of which political leaders later came to regret). Today, however, the partisan chasm in Washington is deeper than it has been in 100 years, according to some academic studies, as moderate blocs in both parties have all but vanished.

�Remember,� said Thomas E. Mann, a senior fellow at the Brookings Institution, �these are really big problems and they�re really tough. Solving them is going to involve some major changes in the way we live, the way we tax ourselves, the way we get our health care and the way we transport ourselves.�

He added: �Many of these questions are caught up in ideological differences that really are quite fundamental. On all of them right now there is no consensus in the country and therefore the political system has to try to create one where none now exists.�

A sign of how hard it is to fashion a compromise on these big questions is the length of time between major legislative actions on them. It took almost a decade from the collapse of the Clinton administration�s health care initiative in 1994 to the passage of the new Medicare prescription-drug benefit. The federal minimum wage went unchanged for 10 years until this spring. The last major overhaul of immigration law passed in 1986. The most recent significant revision to Social Security came in 1983.

Even the relatively new issue of global warming has been batted around since 1988, when Al Gore began talking about its potentially dire effects. Now, despite a foot-high stack of proposed legislation on the subject, virtually nothing has been done.

Mr. Gore said it was extremely difficult to move the political system when it is paralyzed by partisan passion and beset by well-financed and well-organized interests. He refers to the combination of the oil, coal and automobile industries as the �carbon lobby,� which he said is very difficult to defeat.

Washington, he said, has also failed to act on global warming for much the same reason that it has not tackled the possible future insolvency of Social Security or the problem of 45 million Americans who lack health insurance. �There�s just garden-variety denial,� he said. �It�s unpleasant to think about and easy to push it off.�

Washington often serves as a trailing indicator of public sentiment on an issue, following action in state capitals or responding belatedly to a growing public outcry. Congress and the White House did not seriously begin to move on immigration until two years ago, after the Minutemen, a civilian group, started patrolling the borders and Southwestern state governors declared states of emergency to deal with hundreds of thousands of undocumented migrants stealing in from Mexico.

Given the failure of the 1986 immigration legislation to stem the illegal flow, the public is wary of any new government effort to control the borders, said Merle Black, a professor of political science at Emory University in Atlanta. And many lawmakers fear that if they support the current legislation they will be blamed if it fails to live up to its promises. After all, the Medicare drug benefit, too, was a much-heralded attempt to lower the costs of medicines for the elderly, but it created mountains of burdensome paperwork and huge unanticipated costs for the government.

�The public has seen a whole series of performance failures, whether it was the war in Iraq or the response to Katrina,� Professor Black said. �It makes different groups of individuals very skeptical about politicians offering solutions. On top of that, Bush�s approval ratings are so low that he can�t exert any leadership even within his own party.�

Government stasis was not unintended. The Founding Fathers designed the American system of government to cool public passions and created numerous impediments to rash action. They might not be surprised that two decades passed between significant action on immigration law or government old-age pensions. But they might have had trouble conceiving the complexity of the issues facing modern Washington, like global warming or the need to find a way to provide even basic medical care to one in seven Americans.

�It was a pretty simple world Madison was dealing with when he wrote the Federalist Papers,� said Morris P. Fiorina, professor of political science at Stanford University. �His focus was on land, labor and commerce. He was clearly aware of the need to defend the borders, but he was more concerned that you had to limit the reach of government and insure that transitory majorities can�t have their way.�

The molasses pace of governance in America is frustrating to many in and outside Washington. But the framers recognized that the dangers of succumbing to fleeting enthusiasms are often far greater than the slow process of fashioning a consensus from the competing interests of a sectional country.

�I agree that it is a bad thing for it to take an extraordinarily long time to deal with problems,� said Mickey Edwards, a former Republican representative from Oklahoma and now a vice president of the Aspen Institute and a lecturer in government at the Woodrow Wilson School at Princeton. �But I think it is a worse thing to rush into solutions when you�re dealing with a nation of 300 million people.�

He cited Prohibition and the Medicare drug benefit as examples of laws that carried large and unintended consequences.

�I don�t suggest that given enough time you can make everything perfect,� Mr. Edwards said. �But you do need enough time to make sure all views are heard and you can avoid the unforeseen circumstances that plague so many things.�

�You don�t just want them to act,� he said. �You want them to act responsibly.�

WASHINGTON -- Cracks are emerging in congressional Democrats' solidarity, as frustrated lawmakers concede their majority status is not enough to overcome Republican resistance on taxes, spending, Iraq and a host of other issues.

The fissures, which became obvious this week, are undermining Democrats' hopes for several key achievements this year. They also point to a bruising 2008 election in which Democrats will say Republicans blocked prudent tax and spending plans to score political points on immigration and other hot-button issues.

Republicans say they simply want to prevent higher taxes of any kind, even if the targets are not-so-sympathetic groups such as oil companies and hedge fund managers.

After 11 months of insisting that all major programs be paid for with tax increases or spending cuts elsewhere, Senate Democratic leaders acknowledged Thursday they cannot persuade enough Republicans to join them. Majority Leader Harry Reid, D-Nev., reluctantly allowed a vote on a long-debated middle-class tax cut that would add billions of dollars to the deficit because it is not offset elsewhere.

The measure, which the Senate approved 88-5, would prevent the alternative minimum tax from hitting about 25 million more taxpayers, at a cost of about $50 billion to the U.S. treasury next year. Reid's decision puts the Senate at odds with the House with two weeks left before the holiday recess.

House Democratic leaders still insist on a pay-as-you-go policy, or "pay-go," which they made a centerpiece of their governing principles in January.

Reid told reporters Thursday that Senate Republicans have used their filibuster powers to block Democratic efforts to change Iraq policy, move a farm bill and pay for the proposed one-year "fix" to the alternative minimum tax. He especially complained about Republican demands to offer farm bill amendments dealing with state drivers licenses for illegal immigrants.

"We've tried everything we can to address these issues," Reid said, citing 57 GOP filibuster threats this year.

"We have lived by pay-go," Reid said regarding the tax bill. "But what we want everyone to know is that we have tried every alternative possible."

He acknowledged handing a political dilemma to House Speaker Nancy Pelosi, D-Calif. The House earlier passed an AMT bill that would raise $80 billion in new taxes, largely on investors and hedge fund managers.

"I admire the speaker" for adhering to the pay-as-you-go principle, Reid said. He added, however, she "has a little more flexibility from a procedural perspective than I do."

Reid's decision will force a pivotal decision by House Democrats: Should they infuriate millions of voters by leaving the AMT unchanged (and hope Republicans get blamed), or abandon the pay-go promise and possibly rely heavily on Republican votes to pass a bill that splits Democrats.

"If we waive pay-go on this, I think it opens the door" to further actions that would raise the deficit and "border on criminal irresponsibility," said Rep. John Tanner, D-Tenn.

Meanwhile Thursday, congressional Democrats said they face an uphill battle in trying to overcome Senate GOP objections to a House-passed energy bill. Republicans particularly oppose the proposed rollback of $13.5 billion in tax breaks for major oil companies.

"You can't tax your way to energy independence," House Minority Leader John Boehner, R-Ohio, told reporters.

If the Senate cannot overcome the GOP-led resistance, Democratic senators said they may have to jettison provisions important to many House Democrats: the tax provisions and requirements for greater use of renewable energy such as wind, solar and biofuels.

House Ways and Means Committee Chairman Charles Rangel, D-N.Y., said such a move would be difficult for the House to swallow. "The tax part is just as important as any other part" of the energy bill, he said.

As for the Iraq war, congressional Democrats on Thursday sent their strongest signal yet that they are resigned to providing additional funds without forcing President Bush to alter his policies. The plan is virtually certain to divide House Democrats. Like the AMT legislation, it may require significant Republican support to pass.

Democrats, who sometimes seem incredulous at their inability to budge the GOP on tax, spending and war issues, say Republicans will pay dearly at the polls. "There is a sense they are digging their own grave," Sen. Charles Schumer, D-N.Y., said.

Some Republicans agree there is a risk in repeatedly blocking Democratic-crafted bills, especially if the chief beneficiaries appear to be big oil companies or wealthy investors.

"The strategy is to lay low and then blame them for not getting anything done," Republican Rep. Ray LaHood of Illinois said in an interview. "The truth is, we all lose."

"We trash each other and end up making the institution look bad," LaHood said. "That's why Congress' approval ratings are so low."

1. Can anyone tell me what all information about my green card status I need to share with prospective employer attorney to make sure they provide it in H1b application...???

I was laid off in Dec 2009, but severance will stop till early Feb. Now I found two potential jobs. Company A is a corporation in same state, but company B is a university in some other State.

1. How long will take them to transfer my H1B? does the different States matter on this transfer time? I want to make sure which one can submit the H1B transfer before my paycheck stops in Feb.

2. In order to apply for Green Card later, which job is better for Green Card application? I heard university will not help the staff (accountant) for Green Card application. Is that true?

My Status: US Citizenship

I'm planning to file GC for my parents (along with adjustment of status) when they visit me in a couple of months.
I'd a couple of questions regarding the birth certificate requirement.

They were born in Undivided India (before Aug 1947) and their place of birth is now in Pakistan. They migrated to India and have lived in a suburb of Mumbai most of their lives.

- I am planning to get affidavit of birth proving their place and DOB. Does this affidavit need to be on a Indian Govt issued stamp paper to make it look official?
- How do I get around Non availability or No record of the birth certificate requirement as their place of birth is in Pakistan. Can the municipal authorities of Mumbai issue this document?

Can somebody please help by sharing their experience if they are/were in a similar situation.

I will change my employer in April and transfer my H1 with my wife's H4. My wife has found some company which would sponsor her H1B. I am on EB2+485 pending. My wife is on H4(we haven't filed her 485 due to retrogression). I am very confused now. Please help me!

1. My wife's company would apply H1B on April the 1st. My new employer will transfer our H1&H4 after that. Will we have any problem here?

2. My new employer would sponsor me EB1. I have EB2+485 pending. If I apply for EB1 140+485, what will happen my old 485?

3. I am thinking to apply 140 first and if 140 gets approved, I will file 485. I am not sure if I have any risk here. Is there any chance that my EB1 485 gets denied? Do my EB2 485 and EB1 485 have the same chances to get denied?

I am curently on h1b visa on 7th year.My i-140 got approved 3years back and filed i-485 in 2007 and waiting for gc.Now if i switch my job to different employer using my EAD,Can my previous employer revoke my i-140 affecting my gc processing.Does he still have control to withdraw.Can you please help on this.Thanks.

Nobody can predict when the quota will fill up. However, note that there are wide spread rumors about the regular quota being used up as early as the first day and Masters within a few weeks. Its in your best interest to file as early as possible.

Here are the time lines for last year:

Regular Quota: May 26th, 2006

My wife filed I-539 for changing status from H-4 to F-1 at end of May. We have the receipt and the case is now pending. Is it possible for her to request cancellation of this change of status and continue in H-4 status? If so, does anyone know how to ask USCIS for this?

I work for company A which is pretty stable,on a H1b visa. I've no problems except that you will not find another horrible boss anywhere. Trust me, I've worked in quite some places and I've seen pretty bad bosses, but with this guy, you have someone who will always make you look bad and will literally shout at you. I've had enough and I want to switch.
I've around 3 yrs left on h1. The new company will sponsor my H1b and they will start my GC on the first week of my starting. (the person hiring me is a good friend)
The question I have is, what happens to the h1 that company A is holding when I transfer to Company B . There might be a reason company A's CTO might not want me to leave. He also cannot do anything about my boss at this point. It gets little complex at this point, but I want to know if i can work part time on h1b for company A while I work as full time for company B.

Sorry for the big post and thanks for your help.
