we are planning to start an LLC as a group of three here......one of them being in india.i was wondering about the tax issues for a member of an LLC if he is based in India.Can he get an tax identification number.thank you.
Yes you can have international partners in LLC but they also need to pay tax, Unless it is a single member LLC , when you get taxed as individual otherwise you get taxed as a corporations. I think it is better to ask an accountant on how to include the international partner

Please contribute IVians. We need your support to lobby for the current bills which have been introduced.
My perspective on contributing to IV, is that I would gladly contribute $100 if there was a chance that I can get my gc a few months faster because of the efforts of IV.

Some good ideas and thoughts here. Here's my 2c :)
One thing that no one has pointed out and I wonder if people even care about it, but to me its a BIG issue.
All our hard earned $$$$ going into the Social Security and Medicare pool. Has anyone even thought about this ? If you look at your figure closely, it is the amount of money that an average american family saves over 1 year.
I personally feel that it is too big a contribution to let it to waste and for me getting a green card would make me eligible to get all the benefits that I deserve and have rightly earned.

I also got the same message. But it says document mailed and not as Travel Document approved. What does this mean?. IS the AP approved or any RFE on the AP??:confused:

My attorney sent the application to TSC on Aug 14th. Now its with NSC with a receipt date of Oct 9th. Received EAD for my wife. But haven't received AP for either of us.

Hello 9years: Thanks for sharing the info all along. A quick question:
I got my EB2 Labor certified today, and now my lawyer is preparing EB2 140 as an interfile into my existing EB3 485.
Is this recommended or should we do regular premium 140 and request date porting once its approved?
If we do decide to do interfile now during 140 application. Is it advisable to do premium processing?

My attorney and company (both) received copy of Approval Notice. One thing I noticed is Priority Date on Approval Notice is my EB3 Priority Date( October 2003 ). I think some kind update (porting) has happened. I have not seen any change in LUD on my I-485. This is just to update all and hope this information may be useful to someone.

Nope, still waiting for I-140. Opened a ticket with both local congressman and USCIS.
CM replied saying "file is with manager for review".....whatever that means...

Came to USA in March 2000. First company never filed for GC in 2000 and 2001 year. Lost job in 2001. Got consulting work in another state. Later joined 3rd company in 2002.

I have been reading all the posts, in my opinion we all came here broadly because of 2 reasons.
a) Want to earn more money
We have considered our parents are of Middle Class family and We wanted to be the UPPER Class parents to our childern.
b) Want to achieve Career Goals.
We have always considered US is the place where you would find the latest of everything ex. Car, Electronics, Life Style etc.. We wanted to enjoy.
When time passed these things have got changed in our home country, But at the same time we could not make a decision because of other factors which would influence our Decision.
In my opinion IF YOU have become a US citizen MENTALLY then you don't think of going back, You have to ask this question to your self. AM i a US Citizen Mentally or Indian Citizen?. If the answer is Yes to US Citizen then having Green card or not having does not matter, you would stick to US and won't think of going back.
The problem lies with people like me Who could not find a answer to the Question So simply because of following reasons.
a) Professional Life
I like to work in US because, i can spend more time with family, i don't have to drive a lot to go to work, i can leave at 6 every day.
b) Personal Life
I am afraid because i dont like the family or personal life style here is US. I COULD NOT accustom myself to this life style and i am afraid What if my Kids started behaving like American youngster at his/her 20s and 30s, i am afraid about my 60s.
c) How much($$$$) do i need to Settle in India.
when i came to US at first i thought i would go back to india if i have 1 crore, but when time goes by, i came to know that now a days in india people who have 1 Crore are considered as Middle Class, The ultimate reason for me to come here to us is to become UPPER CLASS but the TARGET keeps slipping. Somehow i could not conclude how much i need to go back to INDIA.
So i am also confused like you guys.

You all want something from IV and will contribute only if that something is being pursued. I would look at it other way, IV has no money on its own, so if you do not contribute there is very little IV can do for you. so first contribute and then let us have a discussion on what needs to be done.

What are the chances for the PD moving to Mid 2007 by end of 2010 ? :(
are you referring to EB2-India? Without any legislative or administrative changes the chances of reaching 2007 next year are pretty much zero IMO.
If I were to play the prediction game, based on the stats that USCIS released and their own statements in this months VB, this is what I would guess [Q1 meaning Jan-Feb-March: calendar quarter, not USCIS quarter which runs from Sept]:
- Q1 2010 : EB2-I reaches Feb and or early March
>> Reasoning: its already at Jan-end and there are tons of cases in March. because PERM was about to start from April 2005, lots and lots of companies pushed and filed for labor in March. So Jan will be crossed and most likely Feb also. But March is a big hump to cross.
- Q2 2010 : EB2-I goes "unavailable". Probably in May, or in June
>> EB2-India should exhaust its annual quota for the quarter well within the cases from Jan/Feb/early-March. So now the VB would go unavailable.
- Q3 2010 : EB2-I goes to April/May/June-2005 in July, then Dec 2005 by Sept VB.
>> the big spillover of visa starts. Note that spillover has not yet happened. THere is speculation at this point, but traditionally whenever there is spillover (look at last 3 years VB) India and China have the same PD because thats how the visas can spill over equally to both of them. The state dept's own prediction is dates will reach December and thats likely. Note that in their prediction (in the VB) dates for India and China are identical as is expected when spillover takes place. This is the time when the big bump of cases at March should get levelled out.

If one can handle stress, anxiety and trauma while waiting for GC, then its worth waiting. If not, people like me start looking at options. I applied for Canadian PR in 2008 and just did CDN landing last week which gave my family feel of "cold weather".
I will be completing my 5 years stay in USA this spring. Same story here - I never visited my home country since there is a lot of uncertainty around getting back.
We are 100% sure that we don't want to continue living in USA. Now its matter of time, until summer 2010, that we move on. Just not sure yet - whether it is my home country or Canada. If I get a job back home in India, I would love to do that. From what I have heard from friends, and from recruiters response, in home country, I think economy is picking up. I hope to get some decent job offer based on my unique job profile; if it doesn't work, we will move on to Canada.

USCIS must be busy to get ready for processing and collecting increased fees from these employers soon. The new filing fees will be a huge amount, especially when they decide to file a premium processing request. Can you imagine how much these employers will lose for a single case if the case is filed on premium and denied!! Ouch!
* The new fees will take effect tomorrow since the President is scheduled to sign it into law at 11:00 a.m. EST, tomorrow. "
