Hi,
I just want to know where is my "H1B Visa Extension Application" needs to apply by my employer.
Following are the details,
1. My Employer located in Virginia.
2. My current work location is Minnesota (and applying the H1extension with this Client's letter).
3. This is my second extension; i.e First H1b is for 2 years; and second H1b(i.e extension) for 3 years . all(5years) with the same employer.
4. I have approved I-140 also.
So 1) which will be the Service Center of mine to apply my H1B Extension
2) I heard Approved I-140 will be an advantage for a 3 year H1 extension application, but do this really matter if I have 3 months Purchase order or Contract with the client.
Please let me know.

Yes, this can be done. The H-1 company needs to submit a new I-129 petition requesting a change of status for your brother. Alternatively, your brother can leave the US, apply for an H-1 visa and re-enter in H status.

Does anyone know how slow/fast/better is the Counsular Processing back in India if you ever become eligible to do that?

Don't go for it. It may be fast but you are working with too many variables that may go wrong. I went back home last year for CP and suddenly I became a victim of retrogression. I missed my cutoff date by two days. Then I had to wait for about 3 months to get my H1 stamp. I was lucky that I didn't lose my job here.

The other interesting takeaway is McCain's indication that he'll stand firm in insisting on a guest worker program in the comprehensive immigration reform bill if he's going to work for its passage. Hey there,
I have currently applied for H1B visa under Masters Quota (Regular Processing). And its still under process but I want to know if by any chance I get rejected this year, how much are the chances of being approved when I apply next year. Will it make a negative impact when I apply next year? I am currently on OPT and my course is under STEM. Also let me know if there are any other options.

I've received very good advice from IV members and hope to get this one sorted out here. My in-laws passed away within the last 2 years and wife's younger sister is stressed out. To cheer up we plan to bring her to US for 2 months. Her visa may get rejected for these reasons. No strong family ties in India since the parents passed away. She is an engineer (non-IT) but not employed and she is unmarried and no other siblings in India.
However she is a partner is her father's business and can show the documents as a proof.
What's the best way to get apply for visitor visa
1. I sponsor her visit, by sending bank statements, pay slips and employment letters etc.
2. She applies on her own and show her partnership documents, bank statements etc..
3. She goes through a travel agent like SOTC and book 10 day sightseeing trip and after which she could join us.
Obviously her sister being in US and no parents back home is a big red flag but we can't change that situation.
Any advice will be much appreciated.

Hi Fellow forum users
I and my spouse both have primary/derivative through each other. However I only have EAD (dependent) through my spouse's principal AOS. Can I use that to change my job? I dont have time to apply for a principal EAD. Once I start the new job in dependent EAD can I apply for an EAD based on my primary AOS so that my new employer can drop a AC21 mail to USCIS? The reason I want to do this is to maintain my principal AOS as well.

My AP approvals are lost in mail, my employer mailed them in ordinary mail during holiday season (12/11/07). What can I do next? Go thru attorney for duplicates? Please advice.

I have changed to a new employer and have mailed AC21 documentation to the nebraska service center at the following address using FEDEX.

It is 2 weeks now that the mail has been delivered. So far I have not seen any soft LUD's on either my pending I-485 or approved I-140 cases.
- Would the LUD's be seen at all on these? How many days after sending the docs would you see the LUD typically?
- Is there any way we can call and confirm that the new employer details are applied on my I-485 case?

Rescheduling your FP can delay your background check etc., and can complicate your GC approval timeframe. Its better not to reschedule and stick to the appointment unless their is an emergency.
AFAIK, their is no limit on the number of times you can reschedule though, but its advisable not to reschedule for the reasons mentioned earlier..
