I am working for a MNC and I got L1 visa stamped. After marriage I got my H4 visa stamped.(After L1 stamping) But the Visa officials have not marked the L1 visa cancelled in the passport, does it mean that the Visa is still valid? Does that mean that i can still travel on my L1 visa?
If your L1 petition is still valid (not withdrawn by employer) and you intend to work for that employer (ie. fullfill all other L1 requirements) then yes, you can still travel on L1 and maintain L1 status in the US.

A few weeks ago, I posted a story written by one of our clients, a Registered Nurse from the Philippines employed by a hospital in the U.S., who was stopped and held by CBP officers as she and her family tried to drive north from their home in El Centro, California near the U.S.-Mexican border to Palm Springs to celebrate her husband's birthday. Is it true that they really approved 60000 cases in June. I have a couple of friends that filed I-485 in 2005 and there background is clear too but still have not been approved. I don't understand what is going inside the blackbox. I read in forum that only 40,000 application were ready for approval but then why didn't these people application was not approved all thou there file was complete.

One of my friend's I-485 with priority date of Jan 2006 got approved yesterday. They have posted the documents to USCIS for his wife early this month(as per his attorney) to link to his I-485, but the check was not cashed yet and receipt notice was not issued for his wife.
Will there be any issue in this regard? What will be the options for him just in case if the attorney has not sent the documents to USCIS for his wife or the documents get rejected for some reason? Any help/advice in this regard is really appreciated. Thanks.

I sent the applications(I-140,I-485,I-131,I-765)to Nebraska center 3 weeks ago and it was received by them on December 17,2007(because I tracked the FedEx package).Until today,no receipts yet and my checks are not cashed yet and the receipting update says Current for Nebraska, is the normal or there is something wrong?

You have to return both I-94's while ticketing ie before exiting and while entering at POE IO will give you new I-94 based on AP as Paroled AOS pending..
Ofcourse keep your copy of I-94 from your H1 Extension I-797 approval notice.

I am a US Citizen and will be filing a petition (i 130) to bring my mother over on a greencard.
Recently on her visit to the US on a visitor visa she was marked as NO AOS/COS/EOS on her I - 94
and she left by the date specified on her i - 94.
My question is will it have any effect on her GC petition and what is the current wait time for consular processing on an i-130 petition

I am applying for my H1B extension in apr 2009 for the start date of oct 1st 2009. I have been with the same client for the last 3 years. Following are my concerns:
My client doesn't give any reference letters as per their HR policy. But we have all contract docs/purchase orders from the client since oct 2006. The client extends the project only every 6 months and this has been happening since 3 years. But if USCIS asks a letter/contract which covers the entire contract period for which the H1B extension is requested, what are my options? Please let me know.

No that's not the case, there are stringent reqmts for proof of Date of Birth. Passport is not one of them...
Please check other forums where this has been discussed..

I have been working with company A since december 2005 on my OPT.
Company A filed for my H1 that was approved and the start date for this
visa is december 1st 2006 (OPT expires december 15th, 2006). I am
talking to company B that wants me to join in november but is not sure
if they can file for a transfer before my visa begins. I have looked
around in various forums but havent found a satisfactory answer.
I have pay stubs from company A but, of course, they would be dated from
before the beginning of my visa. Can I use these for my transfer
application? Is transfer even possible in my case?

Hi,
I had a question regarding employment in OPT STEM extension. I recently(one week back) got a job and joined as a independent contractor(adding me as a vendor to company and at the time of joining they asked me to fill W-9 form) in company. I was joined first and thought of ask them to enroll in E-verify later.
But couple of days back when I ask the HR for company to enroll in E-Verify in order to update to school officials. HR refuses to enroll because as I was working as an independent contractor and not coming under their payroll.
Regarding how do I get paid? They will pay me bi-weekly. But I need to rise the invoice and submit time sheet and give it to them so that they will pay me a payable check.
And even I got approved OPT STEM extension couple of days back which I was applied through my previous employer.
Is there a way to come out of this situation?
Even thinking of adding a consulting firm layer in between the company and me but I don't want to do that. Please help me out.

I'm a little confused about my options in starting my H1 extension process and applying for my wife's H4 application.

6 yr H1-B period is ending on Dec 22, 2009. I'm getting married in India in October and will apply for my wife's H4 immediately after. Here are my questions :
1. Will there be any problem with my wife's H4 application if there are just 2 months of validity left on my H1 visa?
2. I could potentially start my H1 extension process now. I'm eligible for a 3 year extension since the Priority date of Jan 3, 2006, on my EB2 application is not current. If I was to start my extension process now, my approval may not happen before October and my lawyer there may be some problems if I travel outside the country on a pending H1 application. Should I apply for my H1 extension now or after I come back to the US in November?

Company A has filed my 485/EAD/AP. I am planning to change company B on AC21 after 180 days. Can I use AP which is filed by company A, for travel purpose after switching to Company B?

I am in a pretty scary scenario...
My I-140 got denied based on inability to pay. My firm did send out the appeal to fight out the case. The appeal was sent 15 days back with the time limit stated in the denial letter. But today, I received the I-485 denial for both me (primary applicant) & my spouse (dependent).
I have H-1 as a back up but my spouse does not have H-4 status.
My Questions & concerned:
1) How long does it take INS to accept the appeal as I haven't seen any update on the same since the package has been delivered (15 days)?
2) What is next possible step for my spouse & how long can he stay in this country without applying for H-4?
3) If the appeal is accepted & the case gets into processing, will I-485 get back on track for processing & can my spouse start working on EAD?
Would appreciate any sought of guidance possible from the expert lawyers & the individuals with the similar experience & knowledge.
Time is very crucial & so immediate reply will be highly appreciated...
