    Yes.

    My I-485 is pending with EB3 Feb 2006 priority date. Invoked AC21 and currently working for a different employer. Have Masters degree and 9+ years of experience.

    Is there a way to re-apply for Green Card under EB2 category thru a 3rd employer and retain the old EB3 priority date?

    Hi,

    This question is to all attorneys for their input on whether there will be another window (or something called pre-filing) for all GC applicants waiting for file their I-485. It would be great if there could be 'pre-filing' with eligibility for EAD since H1 renewals are becoming tougher by the minute.
    Attorneys please add your comments if there is a probability of this happening and if not is there any way we can request USCIS to consider?

    Dear All,
    As I work for a consulting company and my previous lawyer was my employer's ass kisser, I decided to go for a new lawyer.

    (1) Will the new lawyer need any documents from old lawyer? As such I have copies of everything till now
    (2) My employer is in Dallas and I am on a project in New Jersey, but my petition is for my permanant work location in Dallas - is it advisable to choose a lawyer from Dallas (future employment area) or NYC/NJ where I currently have my project (i plan to stay here for a while) - what is the general take - physical accessibility to lawyer or choose lawyer close to company location?
    (3) How hard is it to find lawyers? Last month when dates moved considerably - I heard lawyers have been stressed and over burdened over the mad rush of petitions and have been least responsive - will lawyers take new cases in such situations???
    (4) Can anyone suggest a communicative lawyer? The best of all :)

    Friends,
    I want to request everyone - Members and non member ( they will have to sign up at IV) to please update the all the information for the tracker.

    Please update any communication that you may have had with USCIS, like RFE, Reciept notice and any other information.

    This information can be very useful to IV for generating reports and talk to the officials confidently with data and looking at the trends .. say for RFEs or something else.

    Anonymous users please sign in at IV using any ID , and update all the information related to any communication in the past with USCIS.

    I would request everyone , that after updating the profile please post a comment to this thread , so that this floats on the home page for a couple of days, so that more and more users can read it and update their profiles

    I was laid off in early April, and the employer told me that they would revoke my H1B 30 days later (early May).

    Now finally I get a job offer. The new employer can start to work on my h1b now, but the starting date will be late July.

    I have an EAD right now based on my approved 140 and pending 485 (>=180days)

    I talked with my attorney, and he said I would definitely have to go back to re-activate my H1B abroad, so I should use EAD instead of doing H1B.

    Is it true that I have to go abroad to re-activate my h1B? I saw some people transferred sucessfully

    Any thoughts? Thank you very much.

    I have a quick question. Should I go ahead and apply for my wife's I131 – Advanced payroll too with her 485/EAD. The way I understand 485/EAD/AP is as soon as she gets her EAD, she would want to work and in that case it would be recommended to have a AP too. People suggest that AP should/can be applied later on but I do not see any benefit in saving 6 months/170$.


    Also let me add that my wife will be in US from August 10th to August 26th and then November 10th. As you have to be in country till AP approval should i defer applying her AP now. She is currently on H4.

    Please suggest.

    All,

    My lawyer received an RFE on my EB3/RIR labor cert on priority date 01/26/04In Feb sometime and responded back exactly on the last day (03/01/07) it was due. I have not heard anything back from DBEC since then. Anyone here have any idea how much time they take to approve the labor after RFE is responded back, if at all they do approve it? I know couple of my friends in CA who got their labor approved within a month after their RFE was responded back. My labor was filed from WI.

    Please post your experiences if anyone experienced this before. The RFE was about company's financial document. I am not worried about the financial status of the company as it is doing pretty good from last 3-4 years consistently.

    any info on this issue will be appreciated.

    Hi,

    My OPT was approved and I received the approval notice. But the card itself
    has been lost in mail. I have applied for a replacement card.

    I am aware of something called the "I-9 receipt rule" wherein the receipt for
    the replacement of a lost document can be used in place of the document itself
    for a period of 90 days.

    Does this apply to my case? In other words, can I use the receipt of the replacement
    request to work for upto 90 days?

    PS: I am aware that I cannot start working based on the approval notice itself.

    Hi,
    I have a question regarding the I765 form. In the I 765 form it says Have you ever before applied for EAD to USCIS. I did my MS from US University and got OPT also known as EAD and worked on it for an year. Now my question is do i check yes or no? Do i consider that as EAD or just OPT.

    under OPT you are still on F1 Visa...If you join another degree, you can still have F1, I believe you just need to inform the university on which your visa was issued about the university transfer. International affairs at your new univ. should help in this regard.

    If you are working on H1 then dont renew your AP, you can always travel and enter using your H1. If you plan to use your EAD pretty soon (or your H1 is expiring soon and you dont plan to renew it ) then apply 60 days before you plan to start using EAD and you should be fine.

    You can even apply for AP after the current one has expired, its just that you wont be able to travel till you get your new AP if you have abandoned your H1 status.

    You are ok. As per the USCIS FAQ they would not penalize you on that and your appl. will get accepted if otherwise OK.

    My attorney sent my I-485 at Nebraska center because my I-140 was pending at Nebraska but according to question # 38 on FAQ-3, it should have gone to TX based on June 22, 2007 direct filing directives. Should I file again at Texas center?
