You should be fine. If you I-140 is not approved by 2008, you can apply for a 1 year extension based on the fact you have an approved labor. Otherwise you would get a 3 year extension.

I am working on L1B and also have H1B (without I94) from another employer
I am filing L1B extension and H1B Change of Status at same time

Situation 1) My L1B Extensions paper with (I94) comes prior to H1B change of status paper (with I94),
which VISA will be applicable to me and my dependent spouse

Situation 2) My L1B Extensions paper with (I94) comes after H1B change of status paper (with I94),
which VISA will be applicable to me and my dependent spouse

The big question is that why the so called "IV leadership" is not filling a FOIA request for how many EB3-I cases pending till date. Infact they should ask numbers for all the categories and their priority dates. It should be simple SQL query for USCIS.

This is such a burning issue and so many people are suffering from it. I still don't get it why would IV is not raising this issue... Can some one from leadership group respond please.......

You must submit the 485 through a lawyer if your priority is current, check the visa bulletin. You can always file when 140 is approved and you are still employed with same employer. You can also file EAD & AP for work permit and international travel. Get a lawyer asap.

How can we help ourselves to get 2 year AP ? IV admins, can you kindly share with us any info regarding this ?

I know at this moment everyone is looking at the stimulus plan and economy, but , in the mean time we can prepare ourselves with some plan of action...

May be we should push for 3 year EAD/AP . Our argument should be, if we are 3 or more years away ( like EB3 India is currently 2001 or something ), we should get 3 year EAD/AP

Not meant to talk only for EB3 community, but in general as well.

Any thoughts IVians ?

Hello,
Currently my 485 is pending over 1.5 years with I-140 approval (2007). I was laid-off. I have valid EAD card. Am I eligible to transfer to a TARP company for a similar position but in different state? Is there any specific policy or limitation for this work status? The company's HR couldn't make a decision. What should I do? Thank you very much for your kind and generous help.

Hi Gurus

My I-140 petition was denied 2 months back and My attorney is trying to re apply for it. In the mean while there is a query on the company it self and our attorney is working hard to get it cleared.

In the mean while I am thinking about switch the employer.

I am in 8 th year extension and My VIsa is valid until jan 2008.

1.Assuming some comany offered me to apply for I140 and 485 and join that the company, what will happen If I140 has not been cleared before Jan 2008?.

2.What are the pros and cons I should think about when I switch the company.?
