I know that the EAD card comes directly to the applicant and not to the attorney.

What about RFE on EAD? Does that too come directly to the applicant?

Pls lets know when you get your EAD. It would be interesting to see how long it takes with this avalanche of EAD applications

Hi,
My H1B 6 years will be finished in February. My I140/485 were filed in August and I will be laid off on December 31. What options do I have now?

- My employer had filed my immigration papers at my current work location. They are willing to relocate me to different location but are not sure on the impact of change in address. Can I relocate with my current 140/485 filed for current address?

- Can my H1 be extended based on approved labor? I can then move to new location with same employer on renewed H1B and start the entire process again?

My I-94 extension (for L1B visa) was denied on Oct '08 and I returned in 4 days after they updated Denial status. Reason for denail is "lack of specialized knowledge". I am planning to apply for L1B again in next month (By showing additional certification). Can you please advice me

- is it fine to apply for visa again as it will be more then 6 months after it was denied

- Do I need to show the copy of denial notice during visa interview? Is there any thread available providing suggestions for those applying for visa again after it was denied earlier...

I got green card through marriage. My wife is a US citizen and I came here legally and was in legal status(F-1) before getting married. We got married in August 2005. I applied for green card following year and finally got my card approved March 2008. I got a conditional residence which expires March 2010. I did all paperwork myself. My wife recomend me for an attorney for removal of condition. Attorney tells me that USCIS screwed up and sent me a conditonal residence card as under,"Immigration Marriage Fraud Amendments Act of 1986 (IMFA) on November 6, 1986. INA � 216, 8 USC � 1186a","Under IMFA, an �alien spouse� who obtained the status of an alien lawfully admitted for permanent residence by virtue of a marriage contracted less than 24 months before the date of admission is considered to have obtained such status on a conditional basis."
Now he wants me to send the green card back to USCIS as at the time of approval of my petition my marriage had passed more than two years!
I am confused. I need a second opinion.

Could anyone share their experience/knowledge about getting home loan on EAD? My bank says that, for non-FHA loans, you need to be in any of the visa categories like H1, TN1, GC, ... But its list doesn't include EAD or Adjustment of Status. Can that list be challenged to include EAD? That is, how to convince the bank/lending inst that EAD is a legal/legitimate status like H1?

I have an I-485 that will be current soon, but I am not employed. If they approve it, will that be considered a mistake and make it invalid? Should I withdraw it? Will a letter explaining the situation be sufficient? I have another application as a dependent, just takes longer.

I have an old priority date with previous employer (jan 2006), however my I140 with the new employer has date of May 2007. I can also apply for 485 under NIW. My question is if I apply for 485 by both pathways(two different applications), can I recapture the same PD of the old employer TWICE?

gurus please advise.

I am currently starting a language institute in California. I incorporated the organization 2 years ago, but I am starting it now. I want to hire a Brazilian national on an h2b visa to teach Portuguese but I am worried that as I am starting the business now and haven't generated income yet I won't be allowed to hire this teacher. Is this something I should worry about? Thank you for any help. I appreciate it.

I do not see a problem in filing 2 Green Card applications.The one that comes first gives you a green card which most probably will be employment based.But you may consult an attorney as I am not one.
I am on H1 visa and I have a sister with citizenship.
I am wondering if I can file i-130 (family based immigration) now and file Employment based immigration later?
Is it OK to file 2 green cards applications? which one will take place then?

I dont know if people would be interested in discussing the implications of all EB categories turning current. Some of the points to discuss would be:

1) Processing times for I-485
2) Effects on future GC applications.

etc

3) Whats if the CIR is passed in its current form ? How does that affect these categories is at all

Completed my 6 years on H1B and returned back to India on personal reasons.

1. When I apply for a new H1B after 1 year break, does the H1B comes under the quota or will it be considered on previously held H1B quota.

2. How sure about getting approval of H1B.
