    My I-140 approved in Aug 2007,My employer has withdrawn the I-140 in july but still it is approved in Aug 2007,Now my employer is agreed and want to sent the letter to USCIS not to withdrawn this I-140,As I am in Canada so they are planning to file the I-824 for me for Consular processing,so please advice do they need to file the new I-140 for me for Consular processing as they sent the withdrawn letter to uscis or is it ok for them to sent the letter again to uscis and telling them not to withdrawn this case and file I-824 for CP.Please advice!!!!!!

    I am doing my second masters from a university with a valid i20. I have a CPT till the end of Aug 2008. I have a approval notice for H1B with start date of OCT 1 2008.

    I am planning to discontinue the course from Fall (Starts sep 1st) 2008. Because there is only one month gap between Fall Semester and H1b start, is it possible i stay in the US without taking any courses at the university. i do not mind not working if i have an option to stay back in US till oct 1st.

    i am trying to avoid a hefty fee for the whole semester, i need to fill the gap from SEP 1st 2008 to OCT 1st 2008

    I hear from multiple sources that a concurrently filed 485/140 with 140 in premium is the fastest way to process.
    Does this make sense ?
    It could be as 485 does not have a A number till 140 is approved.
    Once 140 is approved, then have to open the corresponding 485 and enter that information and proceed with its processing ????

    So I believe this one is faster than even the approved 140 case submission of 485 ?
    Any comments ?

    Does anyone have insight or more info on this.
    I just want to know if 485 filed with 140 approved is faster or slower than filing 140PP/485 concurrently ???

    I am in my 5th yr of H1, and my H1 status will expire next year on Nov 1, 2011.
    My I140 filed and is with the appeal Office since jan 2009, with no decision.

    I wanted to know what my options are with the current scenario.

    � What are the chances of this appeal being approved? ( it was denied based on 5 yrs of education vs 6 years)
    � If the appeal is denied, can I transfer the Labor to an EB3, with the same Priority Date?
    � Since there is no decision yet, do I have to file another Labor cert ( a new one) for H1 extension.
    � How can I still maintain this priority date?
    � If I have to file a new Labor cert, can that be done in EB2,with a different job title?

    My friend John Lamb in Nashville blogs today about ICE's Hutto detention center where whole families are jailed while awaiting deportation.     Hi,
    I have applied for my H1B transfer from my current employer to a new company. I have not had any issues with my current employer with pay or anything like that. I have maintained my H1B status with my salary coming on time as promised and have all the paystubs and correct documents. My new employer is a big american MNC and they have hired a well known law firm for transfer process.

    My only question is I have not informed my current employer yet and will inform him in a weeks time once my LCA is done and transfer is filled. He will not be very happy about this and I have initially signed an offer letter which says I will work with him for atleast a year and its only been 6 months so far. Can he create any problems in my transfer by cancelling my current H1 or any other problems with my reliving? Pls help.

    I am getting ready to file for my 485. I have a problem, and I am not sure how to go about it --
    My wife's birth certificate has her name listed differently than it is. The birth certificate has a temporary/pet name. Is there anything I can do now, in next 14 days, before I can file for 485? Will any kind of affidavit help?

    Appreciate all your suggestions.
